On July 4th, 2026 at approximately 0122 hours, I Cpl Rory Brown was patrolling 2nd Ave SE near its intersection with 4th St SE. I observed a red in color 2017 Chevrolet Cruz displaying Alabama tag [REDACTED] traveling West on 2nd Ave SE near its intersection with 3rd St SE. I observed the vehicle traveling at a slow speed and cross the fog line multiple times. I observed the vehicle fail to maintain lane and nearly drive onto the side walk.
I initiated my emergency equipment to conduct a traffic stop. The vehicle slowly rolled until it came to a complete stop on 2nd Ave SE near its intersection with 2nd St SE. During my approach to the vehicle I immediately observed the front and backseat passengers holding an open alcoholic beverage. I also observed multiple empty open containers in the back seat floorboard.
I made contact with the driver Manuel Caal Caal. During my contact with Manuel I observed his eyes to be bloodshot and glassy. I asked if he had anything to drink and he stated one drink. I asked Manuel a second time if he had anything to drink and he stated two drinks. I asked Manuel to exit the vehicle and he did so.
While Manuel was exiting the vehicle I noticed two cold to the touch 12 oz Modelo cans in the driver door. I asked Manuel if he drank two modelos and he stated yes. I asked Manuel to walk to the front of my patrol vehicle and while he was doing so he was unsteady and hesitant. I could not conduct Standardized Field Sobriety Testing due to the language barrier.
I requested a sample of his (Manuel) breath on my Preliminary Breath Test (PBT). Manuel’s sample indicated positive for alcohol. During my contact with Manuel I smelled the odor of an alcoholic beverage coming from his person. Manuel was placed under arrest for DUI. Manuel was placed in handcuffs, behind the back, double locked, and checked for spacing.
While placing Manuel in the backseat of my patrol vehicle it appeared that Manuel had soiled himself. Manuel was placed in the back in the back of my patrol vehicle where he was read Georgia Implied Consent Notice for Suspects Age 21 or Older. Manuel agreed to a state administered breath test.
After Manuel was secured in my patrol vehicle the front seat passenger (Simon Solis Bartolome) and back seat passenger (Inocente Caal Caal) were removed from the vehicle. Both passengers possessed open alcohol containers and did not have any valid identification. Both passengers were placed under arrest for Disorderly Conduct subsection (23)(Possession of Open Alcohol Containers).
A vehicle search was conducted to locate the intoxicant. During the search four (4) sealed and cold to the touch modelo cans. Seven (7) open modelo cans were also located. The vehicle was turned over to Royce’s towing.
Manuel was transported to the Cairo Police Department and processed on the offenses of DUI, Driving without a valid license, Possession of Open Alcohol Containers, and Failure to Maintain Lane. Inocente and Simon were both transported to the Cairo Police Department and processed on Disorderly Conduct.
Manuel provided a sample of his breath on the Intoxilizyer 9000 and it indicated a BrAC of 0.133. Immigration was contacted and placed a detainer on all three arrestees. Inocente and Simon were issued city citations. Manuel, Inocente, and Simon were transported to the Grady County Detention Center and turned over to their staff.
