On this date (03/28/2026), I was dispatched to [REDACTED] in reference to a domestic call. Where the complainant (female) called 911 and used language line (Spanish) to report a physical altercation with her husband.
Upon arrival, I met with the complainant/victim, [VICTIM #1], who relayed the following in Spanish note: as a Spanish speaking officer, I was able to communicate with [VICTIM #1]): [VICTIM #1] stated that on this date, Saturday, March 28, 2026, she had a verbal argument with her husband, Edgar Huerta, that turned physical. [VICTIM #1] stated she and Huerta had a verbal argument about her putting too much salt on an egg that she had cooked. [VICTIM #1] stated Huerta got upset and then asked her if she wanted some cheese with the eggs, she told him no, and he got upset again.
[VICTIM #1] stated Huerta told her that he was not going to eat, she got upset, and she threw and broke a plate on the floor. [VICTIM #1] stated she then went to the bedroom, where her seven (7) months old daughter, [REDACTED] was on the bed. [VICTIM #1] stated Huerta followed her to the bedroom, they continued arguing, Huerta asked her if she wanted the divorce, she stated yes, and the argument turned physical.
[VICTIM #1] stated Huerta had thrown a shoe at her, which hit her on the left side of her face, eye area (note: [VICTIM #1] had a red mark in the area where she stated she was hit with the shoe. Officer James #2610 took pictures of [VICTIM #1]s injuries and uploaded them to evidence.com). [VICTIM #1] stated Huerta had also grabbed her by the arm and threw her on the bed, where their daughter was.
[VICTIM #1] stated Huerta had also grabbed her by the neck and at some point, she fell on the ground, and she hit her elbow (note: I did not see any visible injuries on [VICTIM #1]’s neck, arm, or elbow). [VICTIM #1] stated Huerta had taken her cellphone, as she intended to call her family. [VICTIM #1] stated she tried to go outside and get help from her neighbors, but Huerta prevented her from going outside. [VICTIM #1] stated later she was able to get her cellphone and she called 911.
I Asked [VICTIM #1] if she wanted to press charges, she seemed to be indecisive and then stated no. [VICTIM #1] stated that she did want a Temporary Protection Order (TPO) against Huerta, which I informed her about the process of obtaining a TPO. note: [VICTIM #1] provided me with a written statement, which she completed in Spanish (language).
Then, I met with Edgar Huerta, who relayed the following: Huerta stated he and [VICTIM #1] had an argument about putting cheese on an egg that they were cooking. Huerta stated at some point [VICTIM #1] had thrown and broke a plate on the floor, which he had told her to clean, but she refused. Huerta stated [VICTIM #1] went to the bedroom and he followed her. Huerta stated while they were in the bedroom, they spoke about getting a divorce.
Huerta stated he was upset, he threw two (2) shoes towards the back of the bed, and one (1) of the shoes hit [VICTIM #1] on the left side of her face. Huerta stated he did not intend to hit [VICTIM #1]. Huerta also mentioned that there was a shuffle between him and [VICTIM #1], which I asked him if [VICTIM #1] had hit him, he stated no (Note: I also asked Huerta if he had any injuries, he stated no). Huerta stated their seven (7) months old daughter was on the bed, when he threw the shoes and the shuffle between them happened.
After I met with both parties and obtained physical and testimonial evidence, I have probable cause to arrest Edgar Huerta Jr for Battery-Family Violence for throwing the shoe at [VICTIM #1]s face, which caused a visible injury (red mark) and for cruelty to Children-3rd Degree for committing the Battery-Family Violence in front of their seven (7) months old daughter, [REDACTED].
Later, I advised Huerta that he was under arrest. I Placed Huerta in handcuffs (checked for fit, double-locked), escorted him to my patrol car, searched him incident to arrest, placed him inside my patrol car, and secured him with the seatbelt
Then, I transported Huerta to the Gwinnett County Jail without incident and released him to deputies on duty.
At the jail, I obtained two (2) warrants against Edgar Huerta Jr for Battery-Family Violence (Warrant number 26w-06459) and for Cruelty to Children in the 3rd Degree (Warrant number 26w-06460).
Later, I submitted to records at east precinct a copy of the warrants and a copy of the written statement I obtained from [VICTIM #1]. I Also provided [VICTIM #1] with a victim’s right notification sheet, that included my name/badge number, the non-emergency number, and the case number. Furthermore, I advised [VICTIM #1] on how to obtain a copy of the report.
