[NARRATIVE #1 on June 14, 2026]
On 06/14/2026 at approximately 1905 hours, I, Ofc. Schoenholz, was patrolling in the area of 441 Business Highway near Mountain Express (155 441 Business Highway, Cornelia) when I observed a Harley-Davidson XL1200 motorcycle (GA tag [REDACTED]) traveling northbound and attempting to make a left turn into the Mountain Express parking lot. I then observed a gray Toyota Tundra (GA tag [REDACTED]), also traveling northbound, approach from behind and rear-end the motorcycle. The impact caused the rider to be ejected from the motorcycle and fall onto the roadway.
I observed the rider, later identified as [VICTIM #1], clutching his knee and rolling on the ground following the collision. After witnessing the accident, I activated my emergency lights, positioned my patrol vehicle in the roadway slightly in front of the Tundra, and advised dispatch that a motorcyclist had been struck and that EMS was needed.
The Tundra initially stopped after the collision but then accelerated around my patrol vehicle and continued northbound on 441 Business Highway. I repositioned my vehicle and initiated a pursuit northbound.
During the pursuit, the Tundra passed another vehicle in a no-passing zone marked by solid double yellow lines and subsequently ran a red light at VFW Post Road. The vehicle also drove through the gore area over the 441 Business Highway bridge. My patrol speeds reached approximately 98 mph while attempting to catch up.
As the Tundra approached the southbound on-ramp for 365, another vehicle was already making a left turn onto the ramp. The Tundra attempted to make the same turn simultaneously, drove through the median, and struck a “Do Not Enter” sign, causing it to become airborne. The Tundra then left the roadway and came to a stop in the grass beside the on-ramp.
I exited my patrol vehicle, unholstered my duty weapon, and issued verbal commands for the driver to show his hands. At that time, Habersham County Deputy Holcomb arrived on scene and also had the driver at gunpoint. I then holstered my weapon, opened the driver’s door, and removed the driver, later identified as Alfredo Tomas. Upon opening the door, I detected the odor of an alcoholic beverage coming from inside the vehicle.
With the assistance of Deputy Holcomb and Ofc. Swinehart (who arrived shortly thereafter), Tomas was assisted to the ground and placed in handcuffs, which were checked for proper fit and doublelocked. Tomas was searched incident to arrest, and no contraband was located. I then escorted Tomas to my patrol vehicle, where he was secured in the right rear seat with a seatbelt.
While speaking with Tomas, I detected the odor of an alcoholic beverage on his breath. He also had slurred speech. I also observed a welt forming on his left eyebrow, possibly caused by his head striking the windshield during the crash. I requested EMS to respond to evaluate Tomas.
A search of Tomas’ vehicle incident to arrest revealed two open containers of Corona beer.
Georgia’s Implied Consent Notice for Suspects Age 21 or Over was read to Tomas, and he agreed to submit to the state-administered chemical test of his blood. Tomas provided a sample for a Preliminary Breath Test (PBT), which indicated a BAC of 0.171.
After being evaluated by EMS, Tomas refused transport to the hospital. I then transported him to Habersham County Medical Center, where his blood was drawn by hospital staff without incident. The GBI blood toxicology kit was subsequently turned into evidence.
I then transported Tomas to the Habersham County Detention Center, where he was turned over to jail staff without further incident. I conducted an inspection of the rear seat area of my patrol vehicle before and after transport, with negative contraband both times.
Tomas’ vehicle was removed from the scene by Ramey’s Wrecker Service (list wrecker).

[NARRATIVE #2 on June 14, 2026]
On 14 June 2026, I, Officer Swinehart, 214, was patrolling the area of 385 at the 365 S ramp going north, when Officer Schoenholz, 215, came over the radio and stated she witnessed an accident, a truck versus motorcyclist, and the truck was taking off from the scene and she was pursuing it.
I made a U-turn and was going south on 385 when I came up on the light at Walmart the truck and Officer Schoenholz passed me, so I made another U-turn to get behind them. Officer Schoenholz had her lights and sirens going, and the truck was not stopping or yielding to her or other vehicles.
Officer Schoenholz advised they were on the 365 S. Ramp, and the truck went off the road and had him at gun point. I arrived on scene and Officer Schoenholz along with Deputy Holcomb, 127, with the Habersham County Sheriff’s Office had the driver at gun point. I exited my patrol car and ran over to the truck as Deputy Holcomb and Officer Schoenholz were pulling the drive out of truck. The driver later identified as Alfredo Francisco Tomas, DOB [REDACTED], was put on the ground, and I placed my knee on his arm to assist with getting him into handcuffs. I could smell the odor of an alcoholic beverage coming from his breath. Once Tomas was in handcuffs I was released to go to the motorcyclist.
I arrived back with the motorcyclist. The driver identified as [VICTIM #1], DOB [REDACTED], was limping. The motorcycle was still in the middle of the road. I observed a rip in [VICTIM #1]’s jeans and when he pulled up his pant leg, he had an oval shape that was bloody and appeared to have ripped off the skin. I also observed on the helmet a scratch on the right side and a scuff at the bottom back side. He also had a red spot on his left shoulder toward the front. [VICTIM #1] stated it happened so fast he wasn’t sure if he had hit the windshield of the truck or not. He stated the truck rear ended him.
[VICTIM #1] was transported to Northeast Georgia Medical center in Gainesville by Med5 non emergent.
Ramey’s took possession of the motorcycle.

[NARRATIVE #3 on June 15, 2026]
On 06/15/2026 at approximately 0500 hours, I advised dispatch to contact Ramey’s and request that a hold be placed on the Toyota Tundra in reference to the active investigation, pending the outcome of the victim’s condition and documentation of damage to the vehicle.

[NARRATIVE #4 on June 15, 2026]
On 06/15/2026 at approximately 1930 hours, I contacted the motorcyclist, [VICTIM #1], to check on his condition. He advised that he was required to stay overnight at Northeast Georgia Medical Center due to being in atrial fibrillation (A-fib). When asked if the A-fib was a result of the accident, he stated that hospital staff believed it could be related, but they were not certain.
In reference to other injuries, [VICTIM #1] advised that he had road rash along the entire right side of his body, from his toes to his neck, and was experiencing significant pain.
