On January 7, 2025 at approximately 10:50 hours, I, Deputy N. Ivester responded to [REDACTED BY AGENCY] road Cornelia, Georgia in reference to a possible trespassing call. Before my arrival Habersham County 911 Dispatch advised I could cancel due to the unwanted guest leaving the residence. At approximately 11:00 hours the complainant called back stating things had become physical between the parties on scene. I then responded to the above address.
Upon my arrival I met with the victim identified as [REDACTED BY AGENCY] and noticed his lip to be split open from his mouth toward his nose. I asked what happened and he stated the alleged offender identified as Cole Tech had hit him with a black walking cane. Due to [REDACTED BY AGENCY]’s mouth actively bleeding I contacted Habersham County 911 Dispatch and advised them to have a medical unit enroute to evaluate [REDACTED BY AGENCY]. I then went into the residence to make contact with Cole.
Upon making contact I detained him placing him in handcuffs with his arms behind his back, the handcuffs where checked for fit and double locked. He was then escorted to my patrol vehicle. A pat down search of his person revealed no weapons. He was advised he was not under arrest at this time, he was just detained and he was placed in the rear seat of my patrol vehicle.
I then made contact with the complainant and Cole’s [REDACTED BY AGENCY]. [REDACTED BY AGENCY] stated in the morning hours of this date [REDACTED BY AGENCY] was verbally arguing with him, [REDACTED BY AGENCY] Cole. [REDACTED BY AGENCY] then asked [REDACTED BY AGENCY] to leave the residence and he stated he would not leave without his stuff. [REDACTED BY AGENCY] then called 911 for assistance getting [REDACTED BY AGENCY] to leave.
Due to this [REDACTED BY AGENCY] stated he would leave and walked upstairs to grab his computer. Upon [REDACTED BY AGENCY] returning back downstairs [REDACTED BY AGENCY] and Cole began to fight. [REDACTED BY AGENCY] attempted to break up the fight causing them both to get punched multiple times in the face, arms, and back. After getting away from [REDACTED BY AGENCY] and Cole, [REDACTED BY AGENCY] stated he called 911 again to have a deputy respond. [REDACTED BY AGENCY] completed a witness statement and it will be attached to this report.
I then made contact with Cole. Upon making contact with him I noticed a strong odor of an alcoholic beverage emitting from his person. His eyes were blood shot and watery and he had slurred speech. He was read Miranda Warning and agreed to talk to me. Cole stated he had been drinking in the morning hours of this date. He stated he heard [REDACTED BY AGENCY] arguing with [REDACTED BY AGENCY] and came out to see what was going on. He stated he came down to see his dad and that [REDACTED BY AGENCY] continued to yell and curse.
He then stated he did not mean to hurt [REDACTED BY AGENCY] and brought up that [REDACTED BY AGENCY] was an alleged felon multiple times. Cole stated he picked up a golf club and hit him approximately two times with it due to him being scared of [REDACTED BY AGENCY]. He compared his body size to [REDACTED BY AGENCY] multiple times.
I then spoke with [REDACTED BY AGENCY] stated he woke up at an unknown time due to Cole slamming a door and “raising hell and being loud.” He stated he asked Cole to be quiet and that him saying this escalated the situation. [REDACTED BY AGENCY] stated after saying this Cole went toward the kitchen of the residence and threatened to kill him with a knife. After this [REDACTED BY AGENCY] said [REDACTED] asked him and [REDACTED BY AGENCY] to leave the residence.
[REDACTED BY AGENCY] then went upstairs to gather his computer and other belongings and upon returning downstairs he stated he was “blindsided” by Cole hitting him in the mouth with a walking cane. [REDACTED BY AGENCY] stated he was hit multiple times with the cane while trying to get away from Cole. [REDACTED BY AGENCY] completed a witness statement and it will be attached to this report.
While I spoke with [REDACTED BY AGENCY], LT. G. Cason spoke to [REDACTED BY AGENCY] stated that Cole was slamming doors inside the residence which caused her and her boyfriend [REDACTED BY AGENCY] to wake up. She stated [REDACTED BY AGENCY] got up and went in the bathroom and she went downstairs to eat. Cole then exited his bedroom and [REDACTED BY AGENCY] told Cole to go back inside his room. [REDACTED BY AGENCY] then told [REDACTED BY AGENCY] that her and [REDACTED BY AGENCY] needed to leave.
[REDACTED BY AGENCY] stated they were planning on leaving and Cole told [REDACTED BY AGENCY] that he would kill him and eventually [REDACTED BY AGENCY] had to step in to stop Cole. [REDACTED BY AGENCY] stated as her and [REDACTED BY AGENCY] were about to leave Cole came around the corner with a walking cane and hit [REDACTED BY AGENCY]. She stated she tried to block it and separate them and that eventually Cole and [REDACTED BY AGENCY] separated awaiting law enforecment’s arrival. [REDACTED BY AGENCY] completed a witness statement and it will be attached to this report.
Through my investigation Cole was found to be the predominate aggressor and he was advised he was under arrest. Custody of Cole was turned over to Deputy D. Dorsey to be transported to the Habersham County Detention Center. Cole was charged with Aggravated Assault FVA, Terroristic Threats or Acts FVA, and Underage Consumption of Alcohol. Warrants were completed and reviewed and signed by Magistrate Judge J. Dempsey. Photos were taken by LT. Cason and will be attached to this report.
