Habersham County Dispatch recieved a third party call in reference to a man passed out in his vehicle at the Mount Airy Express, located on Dicks Hill Pkwy at its intersection with GA Hwy 197 S.

Sgt. Young arrived on scene at the Mount Airy Express. Habersham County EMS had made contact with the man who was located in the driver seat of a Toyota Camry that was parked at the fuel station. The man identified as Daovone was in the back of the ambulance being evaluated. Sgt. Young entered the ambulance to make contact with Daovone.

Daovone had a strong, intense odor of alcoholic beverage. Daovone had watery, blood shot eyes. Daovone had thick, slurred speech. Daovone displayed droopy eyelids. Daovone had an elevated pulse, resting at 120 BPM. Sgt. Young understood that ETOH (alcohol) (CNS Depressant) can elevate a users pulse.

Daovone refused any transport to the hospital to EMS staff on scene. Daovone explained that he felt like he was okay. Daovone was asked if Sgt. Young could take a look at his eyes. Daovone agreed. Sgt. Young began with the Horizontal Gaze Nystagmus (HGN) portion of Standardized Field Sobriety Tests (SFSTs). Sgt. Young asked Daovone if he had any injuries. Daovone advised that he did not.

Daovone displayed equal pupil size and without a resting nystagmus. Daovone displayed equal tracking. Daovone displayed 2 out of 2 clues for lack of smooth pursuit. Daovone displayed 2 out of 2 clues for distinct and sustained nystagmus at maximum deviation. Daovone displayed 2 out of 2 clues for nystagmus prior to the onset of 45 degrees. Sgt. Young noted that his angle of onset was nearly immediate. Sgt. Young observed vertical gaze nystagmus. Daovone displayed 6 out of 6 total clues for the HGN portion of SFSTs.

Daovone admitted that he had few “Mich Ultra’s” earlier (common name for Micholob Ultra Beer). Daovone stated that he had been at the fuel station for about 10 minutes prior to EMS’s arrival. Daovone advised that he did not have anything to drink since driving the car to the Mount Airy Express.

Sgt. Young determined that Daovone was less safe to operate a motor vehicle due to his consumption of alcoholic beverages. Daovone was advised that he was under arrest for DUI of alcohol. Daovone was placed into handcuffs, checked for proper fit and double locked. Daovone was secured into the back seat of Sgt. Young’s patrol vehicle. Daovone was read the Georgia Implied Consent Notice for Suspects 21 Years and Older. Daovone agreed to the state adminstered chemical test of a blood draw.

Sgt. Young conducted a search for source of intoxicant inside the Camry. During the search two roosters were located. One was in an animal carrier and the second was in a small box in the back seat. Both roosters appeared severely injured. The roosters appeared to have been in forced combat with other roosters by the lack of feathers, bleeding wounds that match the damage caused by spurs and pecking from an assaulting game rooster. Both roosters appeared to have suffered cruelty that disregarded the general welfare and humanity of livestock or any living creature.

Habersham County Animal Control, Director [REDACTED] was contacted due to the severity of the injury and suspected animal cruetly. HCAC took possession of the roosters on scene. The animal cruelty investigation was refered from HCSO to HCAC to determine possible animal cruetly charges.

Daovone’s wife arrived on scene to remove the vehicle from the investigation scene. Sgt. Young transported Daovone to the Habersham County Jail. Upon arrival Sgt. Young a qualified phlebotomist conducted the blood draw. The GBI blood toxicology kit was submitted into evidence for testing. Sgt. Young had no further contact with Daovone this date.
