On April 6, 2023, at approximately 0037 hours, DEPUTY JOHNSTON was traveling south on HWY 365 approaching Wilbanks Road. DEPUTY JOHNSTON observed a white Honda Accord displaying Georgia registration [REDACTED] traveling south. DEPUTY JOHNSTON observed the Honda traveling 81mph in a 65mph zone and travel over the solid white “fog” line with the left front and rear tires.
DEPUTY JOHNSTON initiated an investigative traffic stop for the violations. DEPUTY JOHNSTON contacted the driver, identified as DONATUS CARROL DOB: [REDACTED], who was seated in the driver seat and [REDACTED] DOB: [REDACTED], who was seated in the front passenger seat. DEPUTY JOHNSTON immediately noticed a strong odor of an alcoholic beverage radiating from CARROL’s breath and person, red glassy eyes and slow/slurred speech. DEPUTY JOHNSTON asked CARROL to exit his vehicle and step to the rear.
DEPUTY JOHNSTON asked CARROL how much he had to drink tonight. CARROL stated a couple drinks. DEPUTY JOHNSTON advised CARROL due to his driving actions, the odor of an alcoholic beverage coming from his breath and person, and him admitting to consuming alcohol recently a DUI investigation was being conducted. DEPUTY JOHNSTON advised CARROL he would be conducting Standarized Field Sobriety Evalutions and asking him questions.
DEPUTY JOHNSTON asked CARROL if he had any medical conditions of any kind. CARROL stated no. DEPUTY JOHNSTON asked CARROL if he was taking any prescription medicines of any kind. CARROL stated no. DEPUTY JOHNSTON asked CARROL if he had any problems with his knees, ankles, or hips. CARROL stated just some arthritis. DEPUTY JOHNSTON asked CARROL what kind of drinks did he have. CARROL stated one beer and a mixed drink. DEPUTY JOHNSTON asked CARROL what kind of beer. CARROL stated a Miller Lite in a glass. DEPUTY JOHNSTON asked CARROL what kind of mixed drink did he have. CARROL stated a moscow mule. DEPUTY JOHNSTON asked CARROL where he had the drinks at. CARROL stated Big Daddy’s.
DEPUTY JOHNSTON asked CARROL when did he last eat. CARROL stated he had some PAPA JOHNS about ten mintues ago. DEPUTY JOHNSTON asked CARROL when was the last time he slept. CARROL stated last night about eight hours. DEPUTY JOHNSTON asked CARROL if he wore glassed or conacts. CARROL stated contacts. DEPUTY JOHNSTON asked CARROL if he had any head trauma or concussions recently. CARROL stated no. DEPUTY JOHNSTON asked CARROL if he had any Ibuprofen or an exessive amount of caffine today. CARROL stated no.
DEPUTY JOHNSTON began a series of Field Sobriety Evaluations, starting with the Horizontal Gaze Nystagmus. CARROL was placed in position while DEPUTY JOHNSTON gave the instructions and began. The following clues/indicator of impairment were observed:
- Lack of smooth pursuit in both eyes.
- Distinct and sustained Nystagmus at maximum deviation in both eyes.
- Onset of Nystagmus prior to 45 degress.
- Vertical Nystagmus present.
CARROL was asked to attempt the Walk and Turn Evalution. CARROL was placed into the instructional position while DEPUTY JOHNSTON explained and demonstrated the evaluation. When CARROL stated he understood the instructions, he was asked to begin. The following clues/indicators of impairment were observed:
- Unable to remain in instruction/demonstration position.
- Started before instructed to start.
- Missed heel to toe.
- Stepped off line.
- Failed to turn as instructed/demonstrated.
Next, CARROL was asked to attempt the One Leg Stand evaluation. CARROL was placed into the instructional position while DEPUTY JOHNSTON explained and demonstrated the evalution. When CARROL stated he understood the instructions, he was asked to begin. The following clues/indicators of impairment were observed:
- Started before instructed to start.
- Sways.
- Dropped foot down muliple times.
- Stopped test before instructed to stop.
DEPUTY JOHNSTON asked CARROL if he thought he was okay to be driving. CARROL stated he thought he was okay. DEPUTY JOHNSTON asked CARROL if he felt a buzz from the alcohol. CARROL stated no. DEPUTY JOHNSTON asked CARROL if he understood drinking and driving was dangerous. CARROL stated yes.
DEPUTY JOHNSTON retrieved his alconsensor and asked CARROL for a sample. He registered a .107. CARROL was taken into custody for DUI. He was handcuffed behind his back, the cuffs wer checked for fit and double locked. CARROL was searched incident to arrest, placed in the right rear, and seat belted in DEPUTY JOHNSTON’s patrol vehicle. DEPUTY JOHNSTON read the implied consent notice and requested blood/breath. CARROL agreed.
List was requested for the vehicle and arrived a short time later. CARROL was transported to Habersham Medical Center where his blood was drawn from his right arm by [REDACTED] and secured into a GBI Tox kit and later booked into evidence. CARROL was transported to Habersham County Detention Center and turned over to staff. He was charged with DUI, FTML and speeding.
DEPUTY JOHNSTON checked his back seat for contraband and returned to service.
