On the date of 09/13/2025 at the approximate time of 23:31 I Sgt. Vaughn responded code 1 to [100 BLOCK] Captains Log Lane, Clarkesville, Georgia 30523 in reference to a dispute that just occurred. Dispatch advised that the caller had walked to her neighbors home to contact 911 because her ex boyfriend had taken her children without permission and had taken her phone. Dispatch advised that there was a language barrier and that the neighbor was translating for the victim.
Upon my arrival I made contact with the victim identified as [REDACTED BY AGENCY] on the neighbors back porch beside her home. [REDACTED BY AGENCY] stated that her ex boyfriend who she shared two children with came to her house drunk around 20 mins ago. The ex boyfriend was identified as Elias Munoz. [REDACTED BY AGENCY] stated that Elias was very drunk and he had taken both her children [REDACTED BY AGENCY] in black Volkswagen Jetta without permission. [REDACTED BY AGENCY] and Elias had never been married or had any custody agreement filed in court. Neither child had been legitimized as well. [REDACTED BY AGENCY] was the sole guardian/legal parent of the children.
After determining that Elias had no legal authority to have the children I started a ping on [REDACTED BY AGENCY] phone which Elias had taken with him from [REDACTED BY AGENCY] home. Exigent Circumstances were present due to Elias being very drunk and kidnaping the children after committing aggravated assault against [REDACTED BY AGENCY]. Dispatch began pinging the Cricket Wireless phone number [REDACTED BY AGENCY] in order to locate Elias and the children. I had dispatch issue a BOLO to all agencies with in the county/and surrounding counties. [REDACTED BY AGENCY] stated that Elias lived with his parents at [300 BLOCK] Pinewood Lane, Cornelia, Georgia. I sent Deputies to that address to attempt to locate Elias and the children but they were not at that home.
I contacted on call investigations B. Hallman and advised her of the incident, Hallman advised me to contact on call GBI and have them issue an amber alert for the child. I had Dispatch contact on call GBI to call me in order to relay information to issue an amber alert for the kidnaped children.
Shortly after dispatch advised that the phone pinged behind the high school. Deputies checked the area and did not locate the suspect or children. The phone then pinged on Wyly Street in Cornelia. Deputies checked the area but did not located the suspect. The phone then pinged on NW Wayside Street near fieldale with 600 meter radius.
Deputies located the suspect vehicle at the end of Slaton Street which was the next street over from where the phone was pinging. The suspect and Children were then located in the yard of [100 BLOCK] Slaton Street, Cornelia, Georgia 30531. I responded code three to this location and took the suspect into custody by handcuffing him behind his back double locked for safety. I then searched Elias incident to arrest and placed him in the rear seat of my patrol vehicle.
Deputy Crawford transported Elias to the Habersham County Jail on my behalf. I had Habersham Dispatch contact the mother via phone to notify her that the children were in our custody as well as her cell phone and the two car seats had been recovered on scene. [REDACTED BY AGENCY] arranged transport to the scene and took custody of her two children and her cell phone and car seats that Elias had stolen from her.
I advised [REDACTED BY AGENCY] to go home and get the children calmed down and safely in her home, Then myself and SGT. Limones of Cornelia Police Department (Spanish speaking officer) would come to her home to go over the incident and conduct a interview with her in a more calm environment. The suspect vehicle was towed from the roadway by Rameys Towing (List Wrecker) and stored in their private lot.
I then left the scene and went en route to [REDACTED BY AGENCY] home at [REDACTED BY AGENCY], Clarkesville, Georgia 30523 with SGT. Limones. Upon our arrival we sat with [REDACTED BY AGENCY] in her living room to conduct an interview.
[REDACTED BY AGENCY] stated that when she arrived home around 22:00 Elias was already at her home waiting on her sitting in his car. [REDACTED BY AGENCY] unloaded the children and car seats and walked in the home. Elias followed her into the home without permission and sat on the couch. Elias had his cousin [REDACTED] and a female named [REDACTED] with him who also came into the home. Elias wanted [REDACTED] to let him sleep with [REDACTED] and he would let [REDACTED] sleep with [REDACTED BY AGENCY].
[REDACTED BY AGENCY] stated that when everyone declined Elias became upset and irate. [REDACTED BY AGENCY] then told Elias that he did not live here and they were not together that he needed to leave. Elias said that [REDACTED BY AGENCY] should leave not him, [REDACTED BY AGENCY] replied that his is her home why would she leave. Elias stated that if [REDACTED BY AGENCY] kept speaking to him that way he would break her face.
[REDACTED BY AGENCY] then walked in the back bedroom and Elias jumped up and followed her. Elias then grabbed [REDACTED BY AGENCY] and punched her in the face. After punched [REDACTED BY AGENCY] Elias grabbed [REDACTED BY AGENCY] by the throat. [REDACTED BY AGENCY] stated that she could breath the first time he grabbed her by the throat. [REDACTED BY AGENCY] tried to get him off of her and he grabbed her by the throat again and choked her to the point she could not breathe. [REDACTED BY AGENCY] had to fight Elias to break free from his grasp.
[REDACTED BY AGENCY] then grabbed her phone and attempted to call 911. Elias snatched her phone away interfering with her 911 call and refused to give her, her phone back. Elias stated that she could have her phone back tomorrow. Elias then stated that if [REDACTED BY AGENCY] did not go and sign the kids over to him tomorrow he would make sure she died tomorrow. [REDACTED BY AGENCY] then escaped from the home and went to the neighbors house to call 911. While [REDACTED BY AGENCY] was gone Elias took the children, her phone and the car seats and fled the scene.
I provided [REDACTED BY AGENCY] with an assistance packet and business card with my name and case number for the report. [REDACTED BY AGENCY] advised that there would be bond conditions forbidding contact from Elias but was referred to superior court for a TPO as an extra precaution. Due to [REDACTED BY AGENCY] injuries I had EMS come to the scene to evaluate her. [REDACTED BY AGENCY] declined to go to the hospital.
I secured arrest warrants for Criminal Trespass, Aggravated Assault FVA, Terroristic Threats and Acts, Kidnaping x2, Cruelty to Children in the 3rd degree x2, Theft by taking MISD FVA, Interference with a 911 call signed by Magistrate Judge Amy Thomas.
