On 07-30-2026, I Deputy Travis Martin and Deputy Brandon Holcomb were stationary on Cannon Bridge Road at its intersection of Garret Road observing the flow of traffic. I heard the distinct audible sound of a vehicle traveling over the rumble strips coming from Highway 115, I observed a Red Ram truck pass by that continued to fail to maintain it’s lane. I entered the roadway behind the red Ram and the driver was tapping the breaks and slowed it’s traveling speed to 47 mile per hour. I initiated a traffic stop by activating my emergency blue lights the driver contiuned bypassing several suffcient places to stop before finally stopping in the middle of the roadway only after we activated our emergency siren. Deputy Holcomb made contact with the driver later identified as Emily Shattuck while I was speaking with the passenger of the vehicle.

Deputy Holcomb detected the odor of an alcoholic beverage from inside of vehicle. I asked Emily to step out of the vehicle and she refused. I ordered Emily to exit the vehicle due to the odor of an alcoholic beverage coming from inside the vehicle. During my time talking to Emily about stepping out of the vehicle I could also detect the odor of an alcoholic beverage coming from inside the vehicle.

Emily stepped out of the vehicle and Deputy Holcomb asked Emily how much she had to drink, Emily stated she had nothing to drink. During this interaction It was confirmed that the odor of an alcoholic beverage was emitting from Emilys breath and person, Emily also had watery and blood shot eyes. Deputy Holcomb asked Emily if she would be willing to do Standardized Field Sobriety Evalutations (SFST) to make sure she was safe to drive, Emily stated no that she takes anxiety medicine and she is starting shake. Deputy Holcomb explained to Emily his level of training on detecting impaired driving and that it wasn’t a set up, that he just wanted to ensure she was safe to drive home, Emily refused. Deputy Holcomb requested Deputy Justin Askey to respond to the scene.

Deputy Holcomb asked Emily if she would blow into PBT and Emily stated she would not. Deputy Holcomb explained to Emily that due to her driving patterns and physical manifestations of alcohol intoxication she would be arrested for DUI, if Emily refused to dispell my suspicion. Deputy Holcomb asked Emily if she would be okay with me checking her eyes and Emily stated yes.

Deputy Askey arrived on scene and did an air sniff with his K-9 around Emilys truck

I ran Emily through Horizontal Gauze Nystagmus (HGN). While Doing HGN I asked Emily if she had any Medical issues that would prevent her from doing HGN. Emily stated that her C2 Vertebrate was shifted 2 milometers to the right and it made her not have good balance. While performing HGN test I observed lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes, onset of nystagmus prior to 45 degrees in both eyes. I did not run Emily through walk and turn or one leg stand due to her injury she had.

Deputy Askey advised me of a positive alert on the vehicle and the vehicle was searched. Inside the vehicle an empty Too Turnt Tea that is 5% alcohol by volume, along with 10mg Vilazodone Emily stated she was taking the Vilazondone. I asked Emily if she would provide a breath sample on a PBT and she stated no.

I placed Emily under arrest for DUI, placing her in handcuffs behind her back ensuring they were checked from proper fit and double lock. I read Emily Georgia Implied Consent for suspects 21 years of age or older, Emily refused. I requested Police Officer Swinehart with Demorest Police Department to come to the scene to search Emily Incident to arrest, Officer Swinehart arrived on scene and searched Emily incident to arrest revealing no contraband. I placed Emily in the rear seat of my patrol car and seat belted her in. I waited for Hulseys towing to take possession of her truck at her request, after Hulseys took possession of the vehicle I transported Emily to the Habersham County Detention Center and turned her over to jail staff without further incident. A rear seat check of my patrol car was conducted revealing no contraband.

Emily was arrested and booked into the Habersham County Detention Center for the following.

1. DUI refusal
2. Defective Tires
3. Failure to maintain lane
4. Possession of an open alcohol container
