On 04/30/2026 I Deputy Crawford heard a BOLO from dispatch of a reported reckless driver. The inital caller advised that there was a red vehicle pulling a trailer that was driving off of the roadway into the grass and almost hitting other drivers. I was responding to the area when dispatch advised of a second call on the same vehicle for a similar report. Sgt. Forrester advised that he had eyes on the vehicle around Kudzu Hill on GA 365 SB. Deputy Forrester attempted a traffic stop on the vehicle and according to him the driver failed to yield and kept driving. Additional units had to block the vehicle and get him to pull over.
When I arrived on scene I observed the vehicle and trailer still sitting partially in the fast lane of GA 365 SB near Mcdonald & Cody law firm. I met with the other units who were at the drivers window of the violator vehicle. I observed the driver looking for his drivers license and he appeared to be fumbling through his wallet slowly looking for his license which he had already passed over. I asked the driver who was identified as Enrique Licon to exit his vehicle. When Licon exited his vehicle he seemed to be unsteady on his feet.
I asked Licon to walk back to my patrol vehicle and I asked him if he takes any medications. Licon advised that he takes some for blood pressure and some when he needs it and some for diabetes. Licon explained that his doctor gave him some medications prior and that he had passed out at work the other day and had to be taken to the hospital. I asked Licon if he would be willing to complete field sobriety tests. Licon indicated that he would. I began the tests with the Horizontal Gaze Nystagmus test. I explained the instructions and Licon indicated that he understood. The following was observed.
- Equal tracking & equal pupil size (both eyes)
- Lack of smooth pursuit (both eyes)
- For the distinct and sustained portion of the test Licon would follow the stimulus out to 45 degrees and then stop looking at the stimulus.
- Licon would not track the stimulus for onset prior to 45 degrees.
I then checked for Lack of convergence which was present. I asked Licon about medical issues that would prevent him from completing the walk and turn or one leg stand portions. Licon advised that he had a knee injury that had happed the day before. I then asked Licon to complete the Modified Romberg test. I explained the instructions for the test and Licon indicated that he understood.
During this test I observed Licon to sway while counting. When the stopwatch was at 2:05 seconds I stopped the test and asked Licon if he understood the instructions. Licon indicated once again that he understood the instructions Licon repeated the instructions back to me which were partially correct. I repeated the instructions for the test and Licon attempted the test again. On the second attempt Licon swayed while counting and estimated the passage of 30 seconds when 35 actual seconds had passed.
I asked Licon what medications he had taken and he said he takes lorazepam for sleep and said that he had taken a tylenol 4 around 8:30 am. I explained to Licon that the lack of sleep combined with his medications is a problem and that he was unsafe to drive. Licon said that if he wanted to keep his job he had to do it. Licon said that he was seeing a pain management doctor and that he got a letter saying that they were no longer having him as a patient.
Due to the totality of the circumstances I determined that Licon was impaired and less safe to drive. I placed Licon into handcuffs and double locked them. I advised Licon that he was under arrest for DUI. I read implied consent for drivers age 21 and over requesting a blood test. Licon verbally agreed. I placed Licon into the rear of my patrol vehicle and he was searched prior to entry. I located 1000 dollars in $100 bills in his front pocket. This was left on his person.
I searched the drivers span of control for sources of intoxicants and located numerous bottles of medications which impair a persons ability to drive or operate heavy machinery. Some of the bottles of medication had the labels worn off and there were a mixture of pills within them some of which did not have any impressions or markings on them. Attached are photos of some of the medications and other pills located within the containers. CVE was requested for the log violations as well as equipment violations on the truck.
I transported Licon to Northeast Georgia Medical Center in Demorest where a blood draw was completed by the lab staff. Upon the completion of the blood draw I transported Licon to the Habersham County Jail where he was turned over to the jail staff without further incident. During transport Licon fell asleep in the rear of my patrol vehicle which is abnormal given the situation. The sealed evidence kit was turned into evidence and all of the medications were turned over to the jail nurse.
