On 05/10/2026 at around 00:20 I Deputy Crawford responded to a rollover motor vehicle crash with unknown injuries located at GA 105 and Twin River Orchard Rd. While responding I heard Lt. Hicks go on scene and advise that there was a subject still in the vehicle.
I arrived on scene and I met with Lt. Hicks and Deputy Helcher who advised that the subject was obviously intoxicated. The evidence on scene showed that Chavez was driving South on GA 105 when he drove off of the side of the road North of Twin RIver Rd. Chavez collided with an embankment near Twin River Rd. Chavez then crossed over both lanes of travel on Twin River Rd. before exiting the roadway again and vaulting. There was also evidence that Chavez rolled his vehicle two times before coming to a final rest off of the roadway and on its wheels. The evidence on scene indicated that Chavez was traveling at a speed that was too fast for the conditions present on the roadway at the time of the crash.
I went to meet with the driver who was identified as Esgardo Chavez. I spoke with Chavez and while doing so I noted that he had an extremely strong odor of an alcoholic beverage emitting from his person as well as glazed eyes. I also noted that when Chavez would look to the side he had Nystagmus. I asked Chavez multiple questions and the only responses he would give were “Georgia” and “Not at all”. Chavez had slurred speech.
I attempted to have Chavez complete the Horizonal Gaze Nystagmus test. I explained the instructions multiple times and Chavez kept saying “repeat”. I waited on EMS to arrive and when they did they had Chavez exit his vehicle for an assessment. When Chavez exited his vehicle I noted that he was very unstable on his feet and swayed while walking. I also noted that there was a bottle of Patron in the passengers seat of the truck as well as a THC vape that was in the back floorboard of the truck as well.
When EMS completed their evaluations Chavez refused treatment and was released from EMS care. Due to the toality of the circumstances it was determined that Chavez was impaired. I placed Chavez into handcuffs and checked for fit. I advised Chavez that he was under arrest for DUI. I read Chavez implied consent for drivers age 21 and over requesting a blood test. Chavez replied with “Not available”.
Chavez was secured into the rear of my patrol vehicle where he then fell asleep. Budgett towing responded to take the vehicle. The vehicle was turned over to Budgett towing. I then transported Chavez to the Habersham County Jail where he was turned over to the jail staff without further incident.
Chavez is charged with DUI, FTML, Reckless Driving, and Too fast for conditions.
