On the previous listed date and time I responded to the listed address reference a domestic dispute. Upon my arrival I met with the victims, [VICTIM 1] and [VICTIM 2]. They stated the received a call from their son’s, Identified as Ethan Hulsey, friends stating Ethan was severely intoxicated and not allowing them to drive. The friends sent the victims their location, and once the victims arrived the friends left.
[VICTIM 1] stated she went to Ethan and tried to get the keys from him so she could drive him home, but Ethan refused to give them over. [VICTIM 1] stated Ethan started to become enraged and was pushing on her, and thats when [VICTIM 2] stepped in. [VICTIM 2] was trying to restrain Ethan, but Ethan started pushing [VICTIM 2] around. Ethan pushed him into the windows of the store and the propane tanks, along with [VICTIM 2]’s vehicle. Finally they were able to get the keys from Ethan so he could not drive the vehicle. Ethan is the victim’s son.
I asked the victims what they wanted done, and [VICTIM 1] stated Ethan needed to learn a lesson. I advised her for the family violence act and, she started crying stating Ethan was in the process of going into the Navy, and it would ruin his ability to do so. I made contact with Ethan who stated nothing became physical, and he just wanted to go home. Ethan had a strong odor of alcohol coming from his breath, and was stumbling around. Ethan stated he and his girlfriend got into an argument and he was just wanting to get home so he could talk to her.
I placed Ethan under arrest for battery and placed him in handcuffs (check for fit and double locked). I placed Ethan in the back of my patrol vehicle and started talking with [VICTIM 1] again. I advised her from her testimony and her plea for him not to be arrested, I would only charge him with disorderly conduct. I advised her it was still a misdemeanor, but it would not be family violence. [VICTIM 1] proclaimed “thank you”.
I transported Ethan to the county jail and released him to the jail staff. I applied for and received a disorderly conduct warrant from the magistrate judge.
