On 01/28/2023, at approximately 0329 hrs I Officer Joey Newkirk 214 was patrolling the area of Wayside Street and Hoyt Street. I witnessed a white Dodge work truck pulling a cement mixer/pump exiting Hoyt Street from the passenger side of my vehicle with no lights on. The vehicle turned into my lane almost striking the front end of my patrol car. I performed a u turn and activated my blue lights to perform a traffic stop.
The vehicle failed to maintain the lane of travel again two more times before Hendricks Street crossing over the center line, also swerving inside the lane of travel. The vehicle then pulled into CVS pharmacy jumping the side walk in front of the store. Officer Mclendon 212 then proceeded to cut in front of the vehicle to get it to stop before it exited CVS parking lot.
I then made contact with the driver. Giovanni Ramirez identified by his Georgia Drivers License date of birth [REDACTED]. While speaking to him, I smelled a strong odor of an alcoholic beverage emitting from his breath and vehicle. I had the driver step to the rear of his vehicle. I asked the driver if he would perform field sobriety evaluations. He stated no he needed to talk to his lawyer.
I then placed the driver under arrest for driving under the influence of alcohol, and secured him in handcuff’s checked for proper fit and safety. I then secured him in the rear seat of my patrol car and read to him Georgia Implied Consent Law for suspects under the age of 21 due to the driver being nineteen years of age. During the reading of implied consent the driver repeatedly kept saying fu*k you no. Fu*k all of you.
Upon checking the drivers license through GCIC, it showed a possible warrant for sexual battery out of Habersham County, and suspended license. I asked the driver if he knew his license was suspended and he stated yes for a previous DUI. Officer Mclendon turned the vehicle over to the registered owner. I then transported Ramirez to the Habersham County Detention Center where he was turned over to jail staff without further incident.
The driver Giovanni Ramirez was arrested and charged with DUI refusal (cit 2142300045), driving on suspended license (2142300050), failure to maintain lane (cit 2142300046), must have headlights on while operating (cit 2142300047), Failure to stop at stop sign (2142300048), tire requirements (2142300049).
