On 10/11/2025 at approximately 0810 hours, I Lt. Joey Newkirk responded non-emergency to 549 North Main Street CVS Pharmacy reference a suspicious subject standing in the roadway telling drivers “Fu*k You” when drivers asked him to move from the roadway.

Upon arriving in the area I witnessed a hispanic male in a green t-shirt, black hat, and khaki pants sitting on the guardrail acting like he was in a mental crisis and punching the air. I got out of my patrol vehicle and made contact with the male asking if he spoke english. He stood up with a blank stare and started to walk toward me I advised him to stop and he threw his hat at my feet after that aggressive move I advised him to turn around to place him under arrest. He picked his hat back up after ignoring my commands threw the hat at me again in a provoking manner and struck me in the lower half of my body around the left leg area.

I then pulled out my taser and activated the red dots to deploy if needed. He then proceeded to run in my direction in an attempt to escape or fight. I deployed my taser at that time making contact with the right arm and right leg of the subject. I then witnessed a male coming from the side of CVS approaching the scene. It was a co-worker of the male identified as [REDACTED BY AGENCY]. He stated that the male just left work and he was looking for him.

The taser deployment caused a full body lock up of the subject causing him to fall face first onto the concrete parking lot. The male subject was detained upon Officer Bakers arrival. The taser deployment caused visible injures to the face and nose of the suspect. Causing blood to be visible from the mouth and nose area. I then checked the area for the prongs and started Habersham Emergency Medical Services to evaluate the individual. I removed the prong from the right arm and right leg just above the knee.

After removing the prongs and started to roll him over to check him for contraband and to pick him up to place him in the rear of my patrol car the hispanic male proceed to spit at my face barely striking my right ear with blood from his mouth. I then pushed on his back and kept him pinned to the ground to prevent the male subject from further spitting blood on myself or Officer Baker.

The hispanic male started to calm down after a few minutes upon the med unit arrival, he stated to his co-worker he found a bag of marijuana on the side of the road and smoked some of it. He stated that after smoking it that it sent him into a rage and he remembers nothing after smoking what he believes to be marijuana.

I then met with the caller and his passenger the caller identified as [WITNESS #1] [REDACTED BY AGENCY], and his passenger [WITNESS #2] [REDACTED BY AGENCY] in the CVS Parking lot.

They stated that they were coming up Northwest Wayside Street approaching North Main when they seen the male in the road asking him to move so he did not get hit. They stated that the male then became irate and started striking his truck but did not damage it. [WITNESS #1] then stated that is when he pulled into the parking lot as the male walked away to call 911 and the male went to the guardrail. He pulled around the building to get away from the male due to the way he was acting.

The co-worker on scene was able to obtain the males first name as Jesus with a date of birth of [REDACTED BY AGENCY] but did not know his last name. The male was transported to the Habersham County Medical Center and escorted by Officer Baker.

I then responded to La Texinita beside CVS where I was able to obtain a full name of the subject as Jesus Galicia Lopez [REDACTED BY AGENCY] with a address of [REDACTED BY AGENCY] in Cornelia Georgia.

I then relayed the information to the med unit and Habersham Dispatch. Immigration and Customs Enforcement was also notified due to the subject not having any type of license or identification. Galicia Lopez was then transported to the Habersham County Detention Center by Officer Baker without further incident. A use of force report was documented and warrants obtained for the charges.
