On 01/24/2023 DS TRAMMELL responded to a report of a MVA involving a possibly Impaired Driver. TRAMMELL arrived on scene and made contact with SGT SEELEY. SEELEY advised he arrived at the scene of the reported crash and noted that the driver, JOEL ROSENBAUM was stuck on the shoulder of the roadway. ROSENBAUM threw his hands out the window as SEELEY approached. When SEELEY was speaking with ROSENBAUM he observed indicators that led him to believe ROSENBAUM was impaired so he contacted DS TRAMMELL to respond to the scene.
SEELEY explained his concerns with ROSENBAUM to TRAMMELL and TRAMMELL began speaking with ROSENBAUM. TRAMMELL immediately noted ROSENBAUM seemed confused and disoriented. TRAMMELL asked ROSENBAUM what happened and he stated he was driving and decided to just pull off the road and got stuck. ROSENBAUM stated it was his first day driving and when asked how long he had his license he stated since he was 17 years old.
When asked further about what happened ROSENBAUM stated he decided while he was driving that he needed to take his phone from the front of the vehicle and reach back into the rear of the vehicle to secure it away from his person. ROSENBAUM explained to TRAMMELL that he inadvertently called 9-1-1 and began speaking about his day. When ROSENBAUM spoke, TRAMMELL noted he was speaking with a thick tongue. ROSENBAUM tried over and over to explain to TRAMMELL what happened but he was unable to do so due to his apparent impaired capacity. TRAMMELL explained his concerns to ROSENBAUM and asked him to submit to voluntary Field Sobriety Evaluations to ensure he was safe to drive and he agreed.
TRAMMELL asked ROSENBAUM if he took any medication and he stated he did. When asked about his medications, ROSENBAUM indicated he took Synthroid for his Thyroid and Tenarol for his Blood Pressure. ROSENBAUM went on to state he took his anti-anxiety medications but as he began to say the name of it he reverted back to repeating the names of the Synthroid and Tenarol over and over.
ROSENBAUM would again make it to his anti-anxiety medication and explain that he was not trying to avoid the question on what antianxiety medications he took, but rather he only wanted to answer the question “appropriately”. TRAMMELL asked ROSENBAUM his highest level of education and ROSENBAUM responded stating he had some college. TRAMMELL confirmed he knew his alphabet and asked him to recite it beginning with the letter “D” and stopping with the letter “X”. ROSENBAUM completed the evaluation in the following manner: D,E,F,G,H,I,J,K,L,M,N,O,P,X,W,R,X.
TRAMMELL confirmed ROSENBAUM did not wear glasses or contacts. TRAMMELL then provided ROSENBAUM the instructions to the HGN Evaluation. At the conclusion of the instructions TRAMMELL ensured ROSENBAUM understood the instructions and began the evaluation. While attempting to complete the evaluation, TRAMMELL had to remind ROSENBAUM several times to keep his head still. ROSENBAUM also had a front to back sway about his person while in the instructional stance.
TRAMMELL noted that after several attempts ROSENBAUM was having consistent trouble maintaining his attention on TRAMMELL’s stimulus. TRAMMEL allowed ROSENBAUM to lean against the front of a patrol vehicle so he could complete the evaluation. TRAMMELL noted again, ROSENBAUM was unable to maintain his focus onto the stimulus.
When TRAMMELL questioned ROSENBAUM willingness to corporate vs just having the appearance of cooperation, ROSENBAUM ensured he was doing his best. TRAMMELL was able to determine via his vocabulary and articulation that ROSENBAUM was an educated person. Given his trouble following the instructions, TRAMMELL moved on to the Walk and Turn Evaluation.
TRAMMELL placed ROSENBAUM into the instructional stance for the evaluation. Once he was in the instructional stance TRAMMELL provided ROSENBAUM with the instructions. At the conclusion of the instructions TRAMMELL asked ROSENBAUM if he understood and he stated he did. TRAMMELL then asked ROSENBAUM if he had any questions and he stated he did not. TRAMMELL then conducted the evaluation and at the conclusion TRAMMELL noted the following clues:
-Broke Instructional Stance
-Stepped Off Line
-Raised Arms for Balance
-Incorrect Number of Steps
TRAMMELL noted ROSENBAUM did not even start the evaluation rather got lost in thought before returning to answering questions that were asked of him upon the initial interview prior to SFST’s. TRAMMELL then moved on to the Modified Romberg Evaluation.
TRAMMELL placed ROSENBAUM into the instructional stance and asked him to maintain the position. TRAMMELL then provided ROSENBAUM with the instructions to the evaluation. At the conclusion of the instructions, TRAMMELL ensured ROSENBAUM understood the instructions. At the conclusion of the instructions TRAMMELL instructed ROSENBAUM to begin. TRAMMELL noted body tremors in ROSENBAUM’s legs and hands. ROSENBAUM completed the evaluation within the acceptable range. TRAMMELL then conducted the Finger to Nose Evaluation.
TRAMMELL placed ROSENBAUM into the instructional stance and provided ROSENBAUM with the instructions at the conclusion of the instructions, TRAMMELL asked ROSENBAUM if he understood and if he had any questions. When ROSENBAUM stated he understood, TRAMMELL began the evaluation and noted the following:
– Pass 1 Raised left finger and held 4″ from face and held until touching pad of finger to left nostril and sliding to tip of nose.
– Pass 2 Raised incorrect hand before correcting and raising right hand touching pad of ringer to the right nostril and sliding to the bridge of nose and held the position before being told to bring finger back down.
– Pass 3 Raised finger to nose touching pad to bridge of nose, and sliding\shaking finger down to tip of nose.
– Pass 4 Raised Right finger in a straight line to nose missing tip and going under right eye.
– Pass 5 Raised finger and held shaking finger in front of face before placing pad of finger onto his face and sliding to his nose and riding down from the bridge to the tip.
– Pass 6 Straight up missed tip of nose and touched cheek with pad of finger sliding to his nose down to the tip of his nose.
Given the totality of the circumstances, TRAMMELL placed ROSENBAUM under arrest for DUI and advised him of such. TRAMMELL then read ROSENBAUM the Implied Consent Notice for Suspects Age 21 and Older. At the conclusion of the notice TRAMMELL asked ROSENBAUM to submit to a blood test and he agreed. TRAMMELL then turned ROSENBAUM over to INV KUSHMAN for transport and met them at the jail for the state administered blood draw. ROSENBAUM’s vehicle was searched and no contraband was located.
ROSENBAUM’s vehicle was turned over to RJ’s Towing and ROSENBAUM was released to jail staff upon conclusion of the state test.
