[NARRATIVE #1 on October 15, 2025]

On October 15th, 2025 at approximately 2203hrs, I, Sgt. Limones and Officer Swinehart were dispatched and responded code three to 623 N Main St, Cornelia, GA (Marathon Gas Station) in reference to a person on the ground and bleeding. As units approached the scene dispatch advised the complainant had called back and advised the call taker that he was assaulted.

As units arrived on scene we observed a latino male later identified as Joivani Sanchez on the floor scuffling with another latino male later identified as Jerry Conde. At first glance it did not appear as the males were fighting until we saw the blood and both males were tangled up in each other. Officer Swinehart immediately began giving verbal commands to both subjects separating them.

It was observed that Jerry was bleeding from his head and face (approximately a 1″ laceration) and a med unit was requested by Officer Swinehart. Jerry was instructed by Officer Swinehart to remain on the ground until a med unit arrived on scene and could conduct a medical evaluation.

There was a third latino male also involved later identified Emanuel Sanchez, Emanuel was part of the altercation and was also our caller. After speaking with Joivani and Emanuel it was established that Joivani and Emanuel are related (cousins). Emanuel said he was at the Marathon Gas Station meeting his ex-wife [WITNESS #1] to exchange their children [REDACTED BY AGENCY] and [REDACTED BY AGENCY].

It was seen on the Marathon’s CCTV footage that Jerry was in the driver’s seat of their vehicle scanning and waiting for Emanuel to arrive, when Emanuel does finally arrive on scene it was seen on video Jerry exited the vehicle and it is visible that words are being exchanged, also seen is [WITNESS #1] while holding [REDACTED BY AGENCY] in her arms is attempting to separate Jerry and [REDACTED BY AGENCY]; yield negative results.

Jerry and Emanuel began exchanging punches while [WITNESS #1] was attempting to place the children in her vehicle. Joivani cousin of Emanuel was allegedly at the Marathon making a purchase when he witnessed the altercation ensue. According to Joivani he was attempting to separate Jerry and Emanuel but ended up in a altercation with Jerry as well which ended up with them being on the ground.

I spoke with [WITNESS #1] and asked her what happened causing Emanuel and Jerry to get involved in a altercation she explained that it was Emanuel’s dinner night with the kids, [REDACTED BY AGENCY] and [REDACTED BY AGENCY]. They had agreed to do a child exchange at the Marathon Gas Station, and [WITNESS #1] explained that the altercations was an ongoing issue.

[WITNESS #1] said that approximately two months prior Jerry and Emanuel were involved in a similar altercation at the Race Trac. [WITNESS #1] said that Jerry and Emanuel were exchanging punches and Joivani then joined in also exchanging punches with Jerry (two against one).

Jerry was transported to Habersham Medical for an evaluation of his injuries (stitches). I followed the med unit to the hospital. Officer Swinehart remained on scene with Joivani and Emanuel which were in her custody and was later transported to the Habersham Detention Center.

Once Jerry was cleared from the hospital I instructed Jerry to place his hands behind his back and I placed handcuffs checking for proper fit and double lock. Jerry was searched incident to arrest; negative contraband. I escorted Jerry to my patrol vehicle placing him in the right rear seat and applying a seat belt across his lap for safety.

I transported Jerry to the Habersham Detention Center were he was turned over to the jail staff without further incident. I conducted a inspection of the rear seat and surrounding areas; negative contraband. Jerry, Emanuel, and Joivani were charged with Affray 16-11-32 and Disorderly Conduct 16-11-39 signed by Judge Thomas.

[NARRATIVE #2 on October 15, 2025]

I, Officer Swinehart responded with Sgt. Limones to 623 North Main st. in reference to an unknown med call at this time we were advise of a male on the ground bleed. While en route another call came out stating someone had been assaulted. I responded code three lights and sirens.

Upon my arrival I see one hispanic man on top of another hispanic male on the ground by the bed of a gray in color Dodge Ram. I exit my patrol car and ask if they were fighting at which point they both advised they were. I gave verbal commands to the first hispanic male identified as Joivani Sanchez to get off of Jerry Conde. Sanchez complied and went to the front of Sgt. Limones patrol car. Conde was advised to stay on the ground. I requested for a med unit due to Conde having a 1 inch laceration on his forehead and bleeding.

While waiting on the med unit to arrive Emanuel Sanchez the other male identified in the fight advised he was meeting his baby mama to drop the kids off when Conde got out of the car and they started to fight and that is when J. Sanchez got out of his car to separate them. J. Sanchez stated he got out of his car and separated Conde and E. Sanchez, J. Sanchez stated Conde kept punching him while he was trying to keep Conde on the ground so he wouldn’t go after E. Sanchez again.

The med unit arrived and Conde was transported to Habersham Medical center for treatment. J. Sanchez and E. Sanchez were both placed advised they were under arrest for Affray and Disorderly conduct at which point both were placed in handcuffs to the rear checking for fitness and double locked.

Both Sanches’s were searched incident to arrest then placed in the rear of my patrol car. Sanchez’s were transported to the Habersham County Detention Center and turned over to jail staff without further incident. Back seat clear of any contraband.
