On 09/14/2025 at approximately 1955hrs, Sgt. Limones 210 received a phone call from Habersham Dispatch requesting assistance translating a 911 hang-up call. The recording captured a Spanish- speaking female crying and requesting police assistance. Dispatch advised Sgt. Limones, as well as myself, Ofc. Schoenholz 215, that the phone’s location was pinging to [200 BLOCK] Linda Way, Cornelia, GA.

Upon arrival, I observed a group of four individuals standing outside the residence. None of them spoke English. I signaled for them to remain in place and proceeded up the driveway. I walked up the driveway and knocked on the door. One of the men at the end of the driveway told me that the door was open, so I entered the residence and announced my presence.

Immediately upon entry, I observed the back door wide open and noted a large amount of food and canned goods scattered across the floor and into the backyard, originating from a vehicle backed up to the door. I could hear a woman crying from a room deeper inside the home. Proceeding down a hallway to the right, I noticed a piece of drywall on the floor. A visibly distraught female, later identified as [VICTIM #1], emerged from the last bedroom on the left. The door jamb to this room was broken.

I entered the bedroom with [VICTIM #1] and observed multiple shattered photo frames on the floor. A flat- screen television was face-down on a dresser. A female who had been part of the group outside entered the bedroom. I asked her in Spanish, “Yo s?” (Do you know?), attempting to gather information. She pointed her thumb outside and said, “Jose.”

[VICTIM #1] then placed her hand around her neck, and upon closer inspection, I observed fresh red marks around her throat. She then showed me bruising on her thigh, and made a striking motion toward the area. On her thigh, I observed two fresh welts. I later learned that a wooden back scratcher (consistent in shape with the injuries on her thigh) had been used to inflict these marks. I then instructed both females to remain in the bedroom while I went to speak with my partner.

Outside, I asked the group who “Jose” was. One male responded, “Yo, yo, yo” (“I am, I am, I am”). I approached him and placed him in handcuffs, Sgt. Limones then check for proper fit and double lock, securing him from the rear. I escorted him to Sgt. Limones’ patrol vehicle placing him in the right rear seat and transferred custody to Sgt. Limones so I could return inside to continue the investigation.

Back inside, I was handed a cell phone with a Spanish-speaking individual on the line, who assisted with translation. Through the conversation, it was confirmed that Ms. [VICTIM #1] sustained injuries to her neck and thigh. She also showed signs of recent scarring from a medical procedure on her belly and under her breasts (unrelated to that night’s incident).

Sgt. Limones then entered the house and took over for translation. [VICTIM #1] explained that she had seen Jose with another woman at his workplace (Fieldale) the previous day. She confronted him during their drive home that night from grocery shopping, which led to an argument. Upon returning home, the argument escalated. Jose began throwing groceries out of the vehicle and onto the ground. She mentioned she was attempting to prepare meals for the week, but the argument continued. First about forgotten trash bags, then again about the other woman.

At some point during the argument, Jose placed his hands around her neck. When I asked if she had difficulty breathing, she stated she did, for about a second. She went to her bedroom to de-escalate the situation, but Jose followed her. He attempted to break the TV on the dresser using a wooden back scratcher. She intervened, and he instead struck her on the thigh. She left the room, and upon returning, found the picture frames smashed. She asked him why he had smashed the picture frames, then closed and locked the bedroom door, leaving him outside the room. He then kicked the locked door in, causing it to rip from the door frame.

[VICTIM #1] agreed to provide a written statement detailing the incident.

Jose was removed from Sgt. Limones’ vehicle and placed in my patrol vehicle, applying a seat belt across his lap for safety. I then transported Jose to the Habersham County Detention Center where he was turned over to jail staff without further incident. An inspection of my patrol vehicle was conducted before and after transport; negative contraband. Jose was charged with the following: Aggravated Assault FVA (16-5-21), Battery FVA (16-5-23.1), and Criminal Trespass FVA (16-7-21).
