On May 11, 2026 at approximately 0045 hours, DEPUTY JUSTIN MCCLAIN was dispatched and responded code 1 (due to being close by in the area) to [REDACTED BY AGENCY] Cornelia, GA in reference to a possible physical domestic which was reported by a third party.
Upon arrival, MCCLAIN made contact with [REDACTED BY AGENCY] (complainant/victim), who stated her boyfriend, JOSE HERNANDEZ (predominant aggressor/arrested), was trying to drive while being intoxicated. [REDACTED BY AGENCY] stated she advised JOSE that she would call the cops if he drove. [REDACTED BY AGENCY] stated she stated she was holding her phone while this was happening.
[REDACTED BY AGENCY] stated JOSE grabbed the phone from her hand to keep her from calling 911 and pushed her, causing her to fall. [REDACTED BY AGENCY] stated after JOSE had the phone he left, this is when she went to a neighbors house to call her son in Atlanta, [REDACTED BY AGENCY], who in turn called 911. [REDACTED BY AGENCY] stated JOSE returned just before deputies arrived on scene. MCCLAIN requested Cornelia Officer RICHARD LIMONES be en-route for translation.
LIMONES arrived and made contact with JOSE, who stated [REDACTED BY AGENCY] phone was going off and he reached to grab it and responded to a few of the messages. JOSE stated [REDACTED BY AGENCY] made him an alcoholic beverage then started arguing about the phone. JOSE stated he left to go to Walmart to let [REDACTED BY AGENCY] calm down. JOSE stated [REDACTED BY AGENCY] called him while he was at Walmart stating if he didn’t come back now she was calling 911. JOSE stated he went back to the residence but she called 911 anyway.
While speaking with [REDACTED BY AGENCY], MCCLAIN observed blood on her left leg. When asked about it, [REDACTED BY AGENCY] stated it was from her hand that was cut when JOSE grabbed the phone from her and pushed her down. [REDACTED BY AGENCY] stated all this took place in the bedroom which is where her youngest son, [REDACTED BY AGENCY] (witness), was watching T.V.
Due to the physical and testimonial evidence, JOSE was placed under arrest with his hands behind his back, checking the cuffs for fit and double locking them. JOSE was searched incident to arrest before being placed in the back seat of MCCLAIN’s vehicle where he was seat belted in for his safety. JOSE was transported to the Habersham County Detention Center where he was turned over to jail staff without incident.
JOSE is charged with Battery-FVA, Interference with a 911 Call, and Cruelty to Children 3rd. Warrants will be taken at a later time. Pictures of [REDACTED BY AGENCY] injuries were taken and are attached to this report. [REDACTED BY AGENCY] was offered medical treatment but refused.
