Habersham County Dispatch advised of a crash, reported by Cornelia Police Department on Baldwin Rd. at its intersection with West Airport Rd.
Sgt. Young arrived on scene. Sgt. Young observed a silver in color, Toyota Corolla in the ditch directly across the intersection from the stop bar at the end of W. Airport Rd. The Toyota failed to turn right or left at the intersection and left the roadway, down an embankment where it came to an uncontrolled point of rest.
The driver identified as Josephine Lukandu, was irate, yelling, sobbing and arguing with officers on scene. Josephine denied any injuries. Josephine had an intense strong odor of alcoholic beverages. Josephine had watery blood shot eyes. Josephine displayed relaxed inhibitions when she would touch Sgt. Young while he was trying to speak and conduct a DUI investigation.
Josephine was asked to conduct the Horizontal Gaze Nystagmus portion of SFSTs. Josephine agreed. Sgt. Young attempted to give Josephine instruction. Josephine however would not follow instruction properly. Josephine was very talkative, and would often vary from calm to very emotional yelling. Josephine had an very strong odor of alcoholic beverage. Josephine explained that she had two Henienken beers earlier. Josephine was from the Democratic Republic of the Congo, and English was a second language. However, Josephine was noticed as she would speak with a thick slur.
Josephine agreed to a preliminary breath test (Intoximeter FST). Josephine’s partial sample was taken. The PBT indicated a positive presence of alcohol on her breath when it displayed (.187) on the display.
Josephine did admit to consuming alcoholic beverages earlier that date. Josephine did fail to maintain lane after she continued through an intersection and crashed her vehicle. Josephine did have a strong odor of alcoholic beverage on her person. Josephine was belligerent, loud, emotional, and uncoordinated in her movements. Josephine displayed many general indications of impairment from alcohol.
Sgt. Young determined that Josephine was less safe to operate a motor vehicle due to her consumption of alcoholic beverages. Josephine was advised that she was under arrest for DUI. Josephine was placed into handcuffs, checked for proper fit and double locked. Josephine was secured into the back seat of Sgt. Young’s patrol vehicle that was checked for contraband prior to and after transport. Josephine was read the Georgia implied consent notice for suspects 21 years and older. Josephine yelled belligerently at Sgt. Young during the notice and did not consent to the state administered chemical test of a blood draw.
Josephine was transported to the Habersham County Jail for booking where she was turned over to jail staff for processing. List wrecker removed the vehicle from the traffic stop. Sgt. Young had no further contact with Josephine this date.
