On the previous listed date and time I responded to the listed address for a physical domestic. Prior my arrival the complainant/victim 1 [REDACTED BY AGENCY], told dispatch her son (offender), Juan Ethridge, and his father (victim 2), [REDACTED BY AGENCY], was in a physical altercation, and Juan was intoxicated. [REDACTED BY AGENCY] stated Juan also threw a shovel at her hitting her in the face.
Upon my arrival, I observed Juan sitting in the roadway right in front of his driveway, and his [REDACTED BY AGENCY], standing in front of him. I made contact with Juan who stood up and started walking towards me with a bloody nose and lips, saying “take me….I did it”. I told Juan to sit on the push bumper of my vehicle, and he walked towards me with his hands behind his back. I told him to relax and just sit on the push bumper and he laid on the hood of my car with his hands behind his back. Again I told him to sit on the push bumper, and he started stumbling and stated he was drunk.
I was finally able to get him to sit on the push bumper, and I asked where his dad was. Juan started yelling it did not matter about his dad to just take him on, which at that point I observed the neighbors around start opening their door to see what the yelling was about. I told Juan to sit with Demorest Officer Brogdon #405 while I go talk to his [REDACTED BY AGENCY] As I turned to walk down the driveway, I heard Juan start to stand up and yell not to go and started walking towards me aggressively.
Officer Brogdon grabbed one arm of Juan as I grabbed the other and escorted him back to the hood of my vehicle and stated attempting to put his hand behind his back to place him under arrest for obstruction. Juan attempted to resist arrest but tensing his arms up, but was eventually place into handcuffs and placed in the rear of my patrol vehicle.
I walked with [REDACTED BY AGENCY] down the driveway to make contact with [REDACTED BY AGENCY]. I asked [REDACTED BY AGENCY] what happened, and she stated Juan had been drinking alot while at home, and after his neighbors went back home, he went over there because he was not ready to go to bed. [REDACTED BY AGENCY] stated she kept trying to get him to go to bed, but he was refusing. [REDACTED BY AGENCY] started to help [REDACTED BY AGENCY] to get Juan to go to sleep, but he pushed [REDACTED BY AGENCY] and started hitting [REDACTED BY AGENCY] stated she thought the shovel was thrown at her but she stated it happened so fast it could have also been the small metal propane tank that was laying on the ground next to the shovel.
[REDACTED BY AGENCY]’s left eye was swollen completely shut from the injury, and there was two lacerations under her eye which looked like this symbol <. After looking at the shovel and tank. I observed blood drops on the shovel which would be consistent with falling drops not being struck with the shovel. I examined the injury and tank and was able to positively ID the tank being the weapon because of the shape of the tip of the torch. [REDACTED BY AGENCY] was treated on scene by med units.
I talked to [REDACTED BY AGENCY], who stated he heard the altercation between [REDACTED BY AGENCY] and Juan and ran out to protect [REDACTED BY AGENCY] Juan started hitting [REDACTED BY AGENCY] which caused a laceration on his forehead and for them to both fall to the ground. [REDACTED BY AGENCY] stated he felt like he twisted his right leg before he fell, but the med unit stated it was clearly a fractured ankle. [REDACTED BY AGENCY] was insistent on not pressing charges on Juan, but after explanation he understood.
I returned to my patrol vehicle and read Juan his Miranda rights, to which he stated “you already have me”. I took that as a non-verbal no, and started to transport him to the jail. During the ride to the jail, Juan asked me “what did they say?… will you tell me what they said?”. I advised him no, and if he wanted to know he could obtain a copy of the report. Juan started saying he did not understand why he was in trouble, when it was his dad that did everything and he did not know why I did not ask for his side of the story. I advised him I attempted to get his side, but he exercised his rights. He started yelling and calling his dad and illegal immigrant, and Juan stated “you just let an illegal, get away with hitting him”. I did not entertain anymore conversation with Juan and arrived on scene at the jail. I released Juan to the jail staff.
