On 6/4/2025 at 1451 hours, I, Deputy Townsend was dispatched and responded code one to Northeast Georgia Medical Center Habersham in reference to a sexual assault on a juvenile. Upon arrival, I spoke to the complainant, Hospital security officer [REDACTED], who escorted me to the victims room. I made contact with the juvenile victim, [VICTIM #1], and her mother, [WITNESS #1].

[VICTIM #1] stated that she went to her aunt and uncle’s, [REDACTED] and Juan Figueroa, house located at [100 BLOCK] Edgewood Dr. Mt. Airy (could be [100 BLOCK] Edgewood Dr) on 6/3/2025 to watch their children, [JUVENILE #1] (4) and [JUVENILE #2] (6), while [REDACTED] went to work. [VICTIM #1] explained that [REDACTED] leaves for work at 1700 hours and she stays the night to watch them. [VICTIM #1] said that Juan was also at the residence. [VICTIM #1] stated she had been in the living room after she put the boys to sleep and Juan came and took her into the bedroom with the children (where she also sleeps when staying at the house). [VICTIM #1] stated that Juan started groping on her buttocks and then took her shorts and underwear off. [VICTIM #1] said Juan put his fingers inside her. [VICTIM #1] advised that Juan had taken his pants and underwear off and was rubbing his p*nis close to her v*gina, but did not put his p*nis inside of her. [VICTIM #1] said she felt like she could not say anything to Juan. [VICTIM #1] said that Juan asked her if she liked it and she said she did not respond.

I asked [VICTIM #1] if this was the first time he has ever done this and she said that this was the second time. [VICTIM #1] said approximately two months ago he groped her breasts repeatedly. I asked [VICTIM #1] if she had showered or changed clothes. [VICTIM #1] said she has not showered and had only changed from shorts into pajama pants, but still was wearing the same underwear.

I contacted Inv. Brittany Hallman and advised her of the situation. The hospital had already notified [REDACTED] at Powerhouse. I was instructed to have the hospital discharge [VICTIM #1] and have her mother [WITNESS #1] drive her directly to Powerhouse to have a SANE exam completed. Inv. hallman was going to meet them at Powerhouse. I provided [WITNESS #1] with a business card, case number, Inv. Hallman’s phone number, and the address to Powerhouse.

The case was turned over to investigations.
