On 07/01/2023 DS Trammell was on patrol in the area of GA 386 and Cannon Bridge Rd. As he was traveling over Cannon Bridge towards Demorest, he noticed a Black Ford F-150 waiting at the traffic signal to continue on 385 towards Cornelia.

Trammell noted the driver, later identified as Kaley Mullis, was not wearing a seat belt. Trammell made a U-Turn and initiated a traffic stop on the vehicle for the violation. Mullis pulled over in the Bojangles parking lot. Trammell approached the driver’s side of the vehicle and contacted the occupants.

He explained the reason for the stop and asked the driver for her license. While the driver was looking for her license, Trammell could smell the odor of Marijuana emitting from the vehicle. When he obtained the driver’s license, Trammell noted she had Bloodshot eyes.

Trammell returned to his patrol vehicle where he confirmed the driver’s license status and the registration on the vehicle. Trammell then returned to the vehicle and reestablished contact with the occupants. Trammell asked Mullis to step from the vehicle and speak with him.

Trammell asked Mullis when she had last smoked Marijuana and she indicated it was approximately one hour prior to the encounter. Trammell went on to advise Mullis that he was concerned she may be impaired given her admitting to smoking Marijuana and her having bloodshot and watery eyes.

Trammell explained to Mullis that he could smell the odor of Marijuana within the vehicle and asked her how much was in the vehicle and where it was located. Mullis stated that there was a small baggie containing Marijuana within the vehicle and it was concealed in a food bag on the passenger’s side of the vehicle.

Trammell retuned to the vehicle and asked the passenger to step from the vehicle. Trammell afforded him the same opportunity and he confirmed that only a small amount of Marijuana was in the vehicle, and it was in a food bag in the floor of his seat. Trammell asked the passenger to step from the vehicle and Trammell removed several knives from his person before patting him down.

Once both parties were out of the vehicle, Trammell asked Mullis if she would submit to voluntary Field Sobriety Evaluations, and she agreed. Trammell asked Mullis if he knew her English Alphabet and she stated she did. Trammell asked her to recite her alphabet beginning with the letter “D” and stopping with the letter “X”. Mullis completed the evaluation with only one error being she stopped at “W”.

Mullis was asked if she had any problems with her knees, legs, or back and she stated she did not. Trammell also confirmed she did not have any recent head trauma. Trammell then moved on to the HGN Evaluation. Trammell explained the instructions to Mullis and confirmed she understood and did not have any questions. Trammell then conducted the evaluation and at the conclusion he noted LOC was present in Mullis’ left eye.

Trammell then moved on to the Walk and Turn Evaluation. Trammell placed Mullis on a painted White line in a parking stall. Trammell confirmed with Mullis that the line was straight, and the ground was level. Trammell then placed Mullis into the instructional stance for the evaluation.

Trammell then provided Mullis with the instructions to the evaluation as well as a demonstration. At the conclusion of the instructions, Trammell confirmed Mullis understood and did not have any questions. Upon gaining confirmation, Trammell instructed Mullis to begin. At the conclusion of the evaluation, Trammell noted the following clues:

– Started Walking too Soon
– Raised Arms for Balance
– Stepped Off Line
– Improper Turn
– Missed Heel to Toe
This totaled 5/8 clues.

Trammell then moved on to the One Leg Stand Evaluation. Trammell placed Mullis into the instructional stance for the evaluation and provided her with the instructions as well as a demonstration. At the conclusion of both, Trammell confirmed Mullis understood and she stated she did. Trammell then instructed her to begin. At the conclusion of the evaluation, Trammell noted the following clues:

– Raised Arms
– Swayed While Balancing
This totaled 2/4 clues.

Next, Trammell conducted the Modified Romberg Evaluation. Trammell placed Mullis into the instructional stance for the evaluation and provided her with the instructions. At the conclusion of the instructions, Trammell confirmed she understood, and she stated she did.

At the conclusion of the evaluation Mullis completed the estimation within the acceptable range, however, Trammell noted she had a 2″ front to back sway along with body tremors and eyelid tremors. Trammell then checked Mullis’ pulse and noted it to be 174 B.P.M.

Given the totality of the circumstances, Trammell placed Mullis under arrest for D.U.I. and advised her of such. Trammell did not want to place Mullis into hand cuffs in front of her children, so Trammell advised her verbally she was being placed under arrest for D.U.I. and read her the Implied Consent Notice for Suspects Age 21 and Older.

At the conclusion of the notice, Trammell asked Mullis to submit to a blood test and she agreed. Mullis’ vehicle was searched and in the aforementioned food bag was located a small baggie labeled “Gorilla Glue #4” which contained a Green Leafy substance consistent with Marijuana.

Trammell allowed for Mullis to arrange for her vehicle, her adult passenger, and her two four-year-old children to be picked up. Trammell then secured her in the rear of his vehicle in hand cuffs behind her back and in a seat belt. Mullis was transported to the Habersham County Detention Center where Trammell conducted the state administered blood draw.

Mullis was then turned over to Jail Staff. The Marijuana that was seized was placed into evidence and Millis was given a Warning for the seat belt violation. Mullis was not readily charged with the Possession of Marijuana, but she was booked on D.U.I., and D.U.I. Child Endangerment X2.
