Sgt. Phillip Young conducted a traffic stop on a red in color, Jeep Cherokee for an observed failure to maintain lane violation on GA Hwy 365 near James Short Tractor.
Sgt. Young observed the red Jeep travel south on the outside (slow) lane of GA Hwy 365. Sgt. Young observed the passenger side tires of the Jeep cross the fog line, onto the shoulder of the roadway. Sgt. Young conducted a traffic stop on the Jeep for the observed failure to maintain lane violation. The Jeep continued into Hall County on GA 365 and did not come to a stop until Mud Creek Rd.
Sgt. Young made contact with the driver identified as Kayla Campbell. Sgt. Young noticed that Kayla displayed watery eyes, facial sores that appeared picked by fluid still wet on her wounds. Kayla appeared to have irregular, involuntary neck and head movements. Kayla appeared nervous as Sgt. Young observed a rapid pulse displayed by her carotid artery. There was also a 13 year old female passenger who was the daughter of Kayla identified as [REDACTED]. Sgt. Young asked Kayla to exit the vehicle.
Kayla exited the vehicle. Sgt. Young asked Kayla if she had any alcoholic beverages this date. Kayla advised that she did not. Kayla was asked if she took any medications. Kayla explained that she did not. Kayla did explain that she thought that she was in heart failure but was not completely diagnosed. Sgt. Young asked Kayla if she would conduct Standardized Field Sobriety Tests (SFSTs). Kayla agreed.
Sgt. Young began with the Horizontal Gaze Nystagmus (HGN) portion of SFSTs. During the HGN portion of SFSTs Sgt. Young observed zero out of six total clues. Sgt. Young understood that some drug categories such as CNS Stimulants do not cause HGN.
Sgt. Young asked Kayla if she had any condition that would prevent her from being able to walk heel to toe along a straight line. Kayla indicated that she did not. Kayla was provided instruction on the Walk and Turn portion of SFSTs. Kayla advised she understood the instruction. Kayla was observed when she raised her arms, wrong number of steps, improper turn, stops. Kayla displayed 4 out of 8 total clues for the Walk and Turn portion of SFSTs.
Sgt. Young asked Kayla if she had any condition that would prevent her from being able to balance on one foot. Kayla indicated that she did not. Kayla was provided instruction on the One Leg Stand portion of SFSTs. Kayla indicated that she understood the provided instruction. Kayla was observed when she displayed, sways, raised arms, and rests raised foot on ground. Kayla displayed 3 out of 4 total clues for the One Leg Stand portion of SFSTs.
Kayla was provided instruction on the Modified Romberg evaluation. During the evaluation Kayla was asked to estimate the passing of 30 seconds of time. During the evaluation Kayla estimated the passing of 30 seconds in approximately 12 actual seconds.
Kayla was asked what time that date she used methamphetamine. Kayla admitted she smoked methamphetamine earlier that date about lunch time. Kayla was asked how often she uses methamphetamine. Kayla explained that she had used for years, and her recent habit was to use daily. Sgt. Young determined based on the totality of the circumstances that, Kayla was less safe to operate a motor vehicle due to her use of methamphetamine.
Kayla was advised that she was under arrest for DUI. Kayla was placed into handcuffs, checked for proper fit and double locked. Kayla was secured into the back seat of Sgt. Young’s patrol vehicle that was checked for contraband prior to and after transport. Kayla was read the Georgia Implied Consent Notice for Suspects 21 years and older. Kayla refused the state administered chemical test of a blood draw.
[REDACTED] was picked up by an aunt [REDACTED] who lives on Mt. Zion Rd per Kayla’s request. The Jeep was removed by family who arrived on scene. Kayla was transported to the Habersham County Jail. Upon arrival Kayla was served with a search warrant for two tubes of blood. Deputy Crawford a qualified law enforcement phlebotomist conducted the blood draw. The GBI blood toxicology kit was submitted into evidence for testing. Sgt. Young served Kayla with a DDS 1205 form. Sgt. Young had no further contact with Kayla this date.
