On April 27th, 2025, at approximately 0124 hours, I, Deputy Holden Helcher, other Deputies, Baldwin Police Department, and Cornelia Police Department, were dispatched and responded to [1700 BLOCK] Alto-Mud Creek Rd, Alto, GA, in Habersham County, in reference to a large fight. Dispatch received multiple calls in reference to a large fight with multiple people occurring at this location. Due to the extensive history at the residence, Sgt. Beam advised to standby until another unit could arrive in the area to assist. As I approached the property, I observed several vehicles begin leaving and could hear yelling and screaming. At that point, I entered the property due to the possible active fight still occurring and to stop any further injury to any persons involved.

Upon arrival, I observed several vehicles fleeing the scene and several subjects walking and running away from the bottom portion of the property. As I approached bystanders, several subjects began pointing towards the horse arena and cow pasture, advising that there was an active fight. I then observed several male subject actively fighting in the bottom portion of the field. I then responded to the field in an attempt to stop the fight. As I approached, I instructed everyone to stop fighting and to get on the ground, due to me being the only unit on scene at the time and multiple people actively fighting. I then made contact with 4 male subjects and 2 female subjects.

As other units arrived on scene, all 6 subjects advised that a Hispanic male, wearing jeans, a black shirt with white dots, and boots, started the altercation at the party. They all stated that the male took off running as into the field as I was approaching them and attempting to stop the fight. I then spoke to a female subject who advised that the male subject wearing the black shirt and white dots started swinging on people and a large fight with multiple people began.

I then spoke with [VICTIM #1], who was involved in the fight. Mr. [VICTIM #1] explained that he did not know the male subject and that he came to the party with other people from Gainesville. Mr. [VICTIM #1] stated that the male started the fight and he was attempting to break the fight up between the male and Mr. [VICTIM #1]’s son. I observed a visible laceration to the bottom left corner of Mr. [VICTIM #1]’s mouth, with blood showing. Mr. [VICTIM #1] advised he wanted to press charges against the male subject if he was located.

Most of the subjects involved in the fight and witnesses who observed it left the scene before myself or other law enforcement officers could make contact with them. Most subjects on scene were also intoxicated and did not want to cooperate with law enforcement or our investigation. I attempted to deploy my multi-purpose K9 in an attempt to track the subject but was not able to due to several livestock animals located inside the fields that the male subject fled into. No suspect information could be provided by Mr. [VICTIM #1] or any one else on scene. All units then returned in service.

At approximately 0222 hours, Sgt. Young advised that he observed a Hispanic matching the description provided by witnesses and Mr. [VICTIM #1], walking along SR365 SB near Mt. Zion Rd. Sgt. Young made contact with the male subject, at which point I responded.

I made contact with the male, Leandro Chavez Rivera, and asked him to explain what occurred. Mr. Rivera was very uncooperative and stated he was walking home. When asked what happened at the party, Mr. Rivera stated he was not at a party and did not know what happened. Mr. Rivera was given another opportunity to explain what happened at the party, at which point he stated he did not know what happened and he was walking home. Due to Mr. Rivera refusing to cooperate with the investigation and provide his side of the incident, I placed Mr. Rivera under arrest for Simple Battery, Disorderly Conduct, and Obstructing Law Enforcement. I checked the handcuffs for fit and double locked them. I conducted a search incident to arrest of Mr. Rivera. Deputy Brewer then transported Mr. Rivera to the Habersham County Jail.

Intent to charge form and victim notification forms were completed. Warrants for Mr. Rivera will be obtained through Habersham County Magistrate.
