On 05/24/2026, at approximately 2300 hours, I, Ofc. Schoenholz, was patrolling in the area of North Main Street and Stovall Street when I observed a gray Nissan Quest (GA tag [REDACTED]) traveling southbound on North Main Street. I observed the vehicle nearly strike a pedestrian crossing sign and swerve abruptly to avoid hitting it.
The vehicle continued on North Main Street and turned right onto Irvin Street, where it stopped past the stop bar at the intersection of Irvin Street and Wells Street. The vehicle then continued straight on Irvin Street, crossing over the double yellow lines numerous times. At the intersection of Irvin Street and Hoyt Street, the vehicle stopped at the stop sign and, upon proceeding, traveled into the opposite lane, driving on the wrong side of the roadway.
The vehicle then accelerated to approximately 45 MPH in a posted 35 MPH zone while roadway conditions were wet due to rain. Based on my training, knowledge, and experience, failure to maintain lane, misjudging clearance, and increased speeds are recognized indicators of possible impairment. I activated my emergency lights to initiate a traffic stop. The driver complied, and the vehicle came to a stop on S. Wayside Street near WastAway.
Upon making contact with the driver, later identified as Pascual Pascual Miguel, I detected the odor of an alcoholic beverage emanating from his breath. His speech was slurred, and he took an extended amount of time to locate his driver’s license due to slow and uncoordinated movements. When asked how many beers he had consumed, he stated “nine.”
I asked Pascual to exit the vehicle, and we walked to the rear of the vehicle. While standing outside with him, I continued to detect the odor of an alcoholic beverage emanating from his breath. I asked if he would perform Standardized Field Sobriety Tests; he refused.
I then instructed Pascual to place his hands behind his back. Handcuffs were applied, checked for proper fit, and double locked. Pascual was searched incident to arrest, with no contraband located. He was escorted to my patrol vehicle and placed in the right rear seat, where he was secured with a seatbelt.
The Implied Consent Notice for Suspects Age 21 or Over was read to Pascual in Spanish, and he consented to a blood draw. I transported Pascual to Habersham Medical Center, where his blood was drawn by hospital staff without incident. The GBI blood toxicology kit was collected and later submitted into evidence.
I then transported Pascual to the Habersham County Detention Center, where he was turned over to jail staff without further incident. The rear of my patrol vehicle was inspected before and after transport, with no contraband located. Pascual’s vehicle was removed from the scene by Cantrell’s (list wrecker).
Pascual “Paco” Pascual Miguel was cited for Driving Under the Influence of Alcohol (O.C.G.A. 40-6 391), Failure to Stop at a Stop Sign (O.C.G.A. 40-6-72), and Failure to Maintain Lane (O.C.G.A. 40-6 48).
