[NARRATIVE #1 on August 07, 2026]

On August 7th, 2026, at approximately 1918 hours, I, Officer Colón, was dispatched to Bigg Daddy’s, located at 137 Hodges Street, Cornelia, Georgia, in reference to a belligerent customer who was refusing to leave the business.

Upon my arrival, I observed a black male, later identified as Roger Dean Powell, being placed into handcuffs by officers already on scene. I approached and assisted officers with gaining control of Powell, getting him to his feet, and escorting him to the rear of my patrol vehicle.

Powell was highly agitated and was not compliant with verbal commands given by officers. Officer Hughes and I attempted to place Powell into the rear seat of my patrol vehicle; however, Powell continued to resist our efforts and refused to comply with instructions. After continued efforts, we were able to gain sufficient control of Powell and secure him in the rear seat of my patrol vehicle.

Based on information obtained from officers who arrived prior to me, Officer Campbell and Officer Hughes had initially attempted to speak with Powell regarding the incident. During their interaction, Powell reportedly assumed a stance and made movements that caused Officer Hughes to believe Powell was preparing to take his legs out from underneath him. Officer Hughes then reacted by attempting to take Powell into custody.

While officers were attempting to place Powell into custody, Powell actively resisted their efforts. During the struggle, Powell grabbed Officer Campbell in the genital area and continued resisting officers’ attempts to place him in handcuffs. Officers had to take Powell to the ground on two separate occasions in order to gain better control of him and safely secure him in handcuffs.

Shortly after I arrived on scene, I assisted the other officers with getting Powell to his feet and escorting him to my patrol vehicle.

Officer Campbell and Sgt. Limones then spoke with the manager of Bigg Daddy’s regarding the incident. The manager requested that Powell be criminally trespassed from the property. I obtained the necessary information and issued Powell a criminal trespass notice from Bigg Daddy’s .

Once Powell was secured in the rear seat of my patrol vehicle, I placed the seat belt across him for safety. I then transported Powell to the Habersham County Detention Center without further incident. I conducted a inspection of my rear seat before and after transport; negative contraband. Roger’s bicycle was transported to the Cornelia Pd by Sgt. Limones and placed in storage, property sheet attached.

[NARRATIVE #2 on August 07, 2026]

On 8/7/2026 I, PO1 Hughes responded to 137 Hodges Street; Bigg Daddy’s in reference to a disturbance.

Upon arrival I spoke with the manager [WITNESS #1] who stated an older black male wearing a red shirt and carrying a black bag was at bar area causing a disturbance by being loud and cussing. I contacted the male described, later identified at Roger Powell. I advised Roger to come outside which he complied.

Once outside I advised Roger to stand in front of my patrol vehicle. Roger failed to comply with my order to stand in front of my car. Roger began walking towards the dumpster area behind the restaurant. I gave verbal commands instructing Roger to return. Roger continued walking away from me. I tactically walked towards Roger, closing the distance between us. Roger then lowered his body in away that I believed he was going to try and attempt to take my legs out from under me. At this time PO1 Campbell and I attempted to maintain positive control of Roger by grabbing his arms. PO1 Campbell and I escorted Roger to the driver side fender of my patrol vehicle. Roger began to tense his body and pull away from both officers, and we then attempted to place him into wrist restraints. Roger attempted to turn away from us; Officer Campbell and I maintained positive control while attempting to restrain Roger.

Roger was directed to the ground for his safety and ours. I was then able to safely place Roger into handcuffs behind his back (checked for fit and double locked). Sgt. Limones arrived on scene and assisted in placing Roger into Handcuffs. Sgt. Limones then advised Habersham Dispatch that we had one male in custody.

After a search of Roger’s bag, I was able to locate Roger’s identification. I then advised dispatch to run a GCIC check; dispatch advised that Roger had no wants.

At this time, I assisted PO1 Campbell in helping Roger to his feet. Roger was then placed against my patrol vehicle in an attempt to search incident to arrest. Roger was still resisting and attempting to pull away from officers. .

At this time PO1 Campbell advised that Roger was trying to grab Officer Campbell’s genitalia while handcuffed behind his back. Due to Roger’s aggressiveness Sgt. Limones directed Roger to the ground to maintain positive control while giving verbal commands. I then spoke with the manager and requested if she would be willing to complete and witness statement form; which she did. At this time, I assisted PO1 Campbell and Officer Colon in placing Roger into the Rear of Colon’s Patrol vehicle. Roger did not get into the rear of the patrol vehicle at first. Roger began acting like he was asleep and would not comply with the lawful order. Roger was then placed into the Patrol vehicle with assistance. Once in the rear of the Patrol vehicle Roger raised his leg up as if he was going to try and kick PO1 Campbell. We were then able to secure Roger into the patrol vehicle.

[NARRATIVE #3 on August 07, 2026]

On August 7th, 2026 at approximately 1722hrs I, Sgt. Limones was dispatched and responded code one to 137 Hodges St, Cornelia, GA Bigg Daddy’s in reference to a disturbance.

Upon arrival I observed Officer Hughes and Officer Campbell struggling with a black male later identified as Roger Powell, both Officer’s had directed Roger to the ground because he was resisting arrest. Roger was yelling and was non-compliant, once on the ground both Officer’s were able to restrain Roger.

Roger was assisted to his feet, I observed the odor of an unknown alcoholic beverage emanating from Roger’s person, Roger was not making any sense when speaking, and his words were slurred. Once Roger was on his feet Officer’s were searching for weapons and or anything illegal when Roger began attempting to pull away from Officer’s. At this time I stepped in and directed Roger to the ground to gain control, I gave Roger verbal commands to calm down, but yielded negative results.

Once again Roger was assisted to his feet and Officer’s escorted Roger to Officer Colon’s vehicle where he was placed in the right rear seat. I made contact with the manager [WITNESS #1] she advised that Roger came in to the establishment being loud, he had two drinks and became even louder and belligerent. [WITNESS #1] said Roger was asked to leave but refused, that is when Law Enforcement was notified. I asked [WITNESS #1] if anyone was injured or did he attempt to get physical with anyone, [WITNESS #1] said no that he was just disruptive and boisterous with profanity.
