On the 21st day of September 2025 I deputy Holcomb responded emergency with my emergency equipment activated to [REDACTED BY AGENCY] in reference to a domestic. While in route, I was told by the habersham county E911 Center that the [REDACTED] lived at [REDACTED BY AGENCY] and was woken up by a female and male yelling at each other in his front yard. The subject went outside in the male fled.

Upon my arrival, I was met in the driveway of [REDACTED BY AGENCY] by the complainant/victim identified as [REDACTED BY AGENCY]. She stated that her boyfriend who was staying with her this evening was intoxicated and out of his mind, woke up from his sleep and began to attack her. She stated that he was punching her in the arm and the leg. This was being done in front of her two small children.

She stated that she grabbed her phone to call 911 but the boyfriend destroyed the phone to keep her from using it. [REDACTED BY AGENCY] stated she was able to grab her oldest child and flee the residence on foot. She stated she went to the Neighbor’s house at [100 BLOCK] and began banging on the windows in an attempt to get help. While speaking with her, she stated the subject had went back to the residence at [200 BLOCK] where a small infant child was located.

Myself and deputy McClendon responded to this location. What’s at the Camper/residence we knocked on the door where no one announced themselves. With exigent circumstances, needing to check the welfare of the small infant child. We opened the door to the trailer. From the porch, I could see a male subject, laying on a bed with a cover over him. I gave him verbal commands to show me his hands. He stated no. I could see the hair of the infant protruding from under the blanket.

At this point, I knew the male adult had the small child in his grasp. I entered the home and remove the blanket from them. I began ordering him to let go of the child where he refused. I physically pulled the adult male towards the end of the bed where he remained grasped to the infant child. The adult male began to roll over on top of the child putting his body weight on the child. I then got on the bed and physically had to pull his arms from around the baby to remove the baby from his grasp.

I turned and sat the baby on the floor due to the male subject, not following orders or commands from deputy McClendon to put his hands behind his back. Myself and McClendon were able to subdue the subject and place him in handcuffs behind his back. I picked the infant child up and walked him to the door and handed him to other deputy’s outside the residence.

On the bedside table, I observed a black galaxy cell phone that was busted from front to back. The phone was unusable. I returned to meet with the complainant [REDACTED BY AGENCY] who had already completed a witness statement. I observed bruising on her right bicep and her left leg. These were photographed.

The boyfriend now identified as Salvador Gutierrez, was seatbelted into the rear seat of my patrol vehicle. Cuffs had been checked for fit and double locked. He was searched incident to arrest, revealing no contraband. I transported him to the Habersham County Sheriffs Office where he was turned over to detention staff without incident. The rear seat of my patrol vehicle was checked prior to, and after transporting, revealing no contraband.

Warrants for cruelty to children first degree, two counts of cruelty to children third degree, obstruction of officers, criminal damage to property second degree and battery FVA were taken and signed by Judge Thomas.
