[NARRATIVE #1 on August 04, 2026]

On 8-4-2026, At approximately 16:43 Habersham Dispatch announced a BOLO (BE ON LOOK OUT) in the area of Stonecypher Street and Lee Street for a Silver in color 2010 Dodge Caliber bearing Georgia tag: [REDACTED]. Habersham Dispatch advised the vehicle was stopped in the middle of the road on Stonecypher Street in front of Cornelia Gardens and the driver was possibly under the influence of drugs.

While patrolling in the area I located the vehicle on the corner of Lee Street and Stonecypher Street. As I was pulling up to the vehicle, I noticed the driver was making sporadic movements by looking over her shoulder looking into the rear seat of the vehicle from the driver seat. As I made contact with the driver identified as Stacy Cozart by her driver’s license. I asked Cozart what she was doing sitting in the corner and she said she is trying to decide if she was going over here to eat or going home to eat. I instructed Cozart to exit the vehicle due to the BOLO that went out via dispatch. As I was speaking to Cozart I noticed more sporadic movements coming from her.

I asked Cozart if she would willingly complete standardized field sobriety Evaluations for me; Cozart agreed. I first asked Cozart if she wore contacts or glasses which she said she did not. I then asked if she had any medical problems with her neck, back or feet. Cozart said that she was just tired. I proceeded to perform Horizontal gaze nystagmus evaluation. Cozart’s pupils were constricted and none reactive to light.

I explained the second portion of my evaluation. I began by explaining the instructions to Cozart’s, placing her in the start position. While trying to explain the instructions Cozart would attempt to get out of the starting position and take approximately an 18-inch step and said multiple times that she was flat footed.

Cozart was explained the instructions and asked if she understood which she stated “yes”. Cozart then said she could not perform the evaluation because she was flat footed. The third evaluation in my field sobriety evaluation was the one leg stand.

I first explained the instructions to Cozart and instructed her to count out loud as to be heard by me, I advised her that I would tell her when she could stop counting. Cozart then proceed to count to 3 setting her foot down and stated, “I did it”.

After I concluded my evaluations, my determination was that Cozart was under the influence of a narcotic, I turned the investigation over to MPO. Nesbitt for further evaluation.

MPO. Nesbitt advised that I had enough evidence to make an arrest. I instructed Cozart to turn around and place her hands behind her back. Cozart complied with my instructions, Cozart questioned why she was being taken into custody, I explained that she was under arrest for DUI, Cozart responded by saying “F*ck you”. Cozart was placed into handcuffs with her hands behind her back (checked for fitness and double locked).

I then read Georgia implied consent notice for persons over the age of 21 and requested a sample of her blood. Cozart said yes at first then when I asked her for a sample of her blood Cozart stated “I do not answer any questions”. I advised Habersham Dispatch that she refused the blood test due to her stating she did not answer any questions. Cozart was then placed into the rear seat of my patrol vehicle and seat belted in for safety.

Cozart released her vehicle to [REDACTED]. I then transported Cozart to the Habersham County jail where she was turned over to jail staff without incident. A check of the rear seat of my patrol vehicle before and after transport revealed no contraband.

[NARRATIVE #2 on August 04, 2026]

On August 4, 2026, at approximately 1643 hours, I, Officer Nesbitt, was dispatched to Stonecypher at Lee Street in reference to assisting Officer Hughes with a traffic stop. Upon my arrival, I observed Officer Hughes administering field sobriety evaluations to the subject/Cozart. Officer Hughes asked if I was ARIDE certified, and I advised him that I was.

I then made contact with the subject and conducted additional evaluations. I instructed the subject to close her eyes for approximately 10 seconds and then open them. During this evaluation, I observed that her pupils did not dilate and remained constricted and pinpoint. I asked the subject what medications she was currently taking. She advised that she was taking Wellbutrin and another medication to assist with sleep. I asked the subject if she was employed, and she advised that she was not and was currently receiving disability. I asked what disability she had, and she stated that she had a back injury. I asked if she was able to walk in a straight line, and she advised that she could, but sometimes became unsteady because she was flat-footed.

I then spoke with a friend of the subject, identified as [REDACTED]. [REDACTED] advised that he believed the subject should not be driving due to the powerful prescription medications she was taking. [REDACTED] stated that one of the medications was oxycodone. I asked [REDACTED] if he had seen the medication, and he advised that he had. [REDACTED] further stated that he takes the subject to her doctor’s appointments and is aware of the medications she is prescribed.

I then returned to the subject and (Rhomberg) instructed her to tilt her head back, close her eyes, and internally count to 30 seconds. I instructed her to open her eyes and look at me when she believed 30 seconds had elapsed. The subject counted to approximately 43 seconds before opening her eyes.

I asked the subject if she had any oxycodone inside her vehicle. She advised that she did not believe her purse was inside the vehicle. I asked the subject for consent to search her vehicle, and she provided consent.

While on scene, [WITNESS #1] arrived and advised that she had observed the subject driving on two separate occasions earlier that day. [WITNESS #1] provided a written witness statement regarding what she had observed.

I conducted a search of the vehicle with the subject’s consent. During the search, two bottles of oxycodone were located inside the vehicle. No other illegal items were located.

The subject requested that [REDACTED] take possession of the vehicle and drive it to her residence. I contacted the manager of Cornelia Gardens and requested that the vehicle be secured and that the subject’s medications be placed in a safe location.
