On 07/26/2026 at approximately 8:50 p.m. I, Lt. Pontes 208 responded in a code one status with Ofc. Schoenholz 215 to Fieldale’s parking lot for a subject acting erratic.

Upon our arrival we came in contact with the subject in question later identified as Victor Barragan. Due to my training and experience it was clear that the subject was under the influence of some type of narcotic.

Barragan was walking around the parking lot yelling and screaming and cursing then would calm down for a couple of minutes then get extremely agitated just by our presence. We then requested a med unit for Barragan at his request. We attempted several times to get him to calm down but it did not work. The fire department and ambulance finally arrived on scene. It took several minutes to talk Barragan into getting in the ambulance so he could be checked out. Ofc. Schoenholz went to pat the subject down before getting into the ambulance for their safety.

Barragan begin to resist by pulling away, that was when Ofc. Schoenholz noticed what appeared to be a pistol under his hoodie and shirt. I then assisted in removing what was a H&K bb pistol. Barragan was then placed in handcuffs for his safety and all other people on scene. Three deputies from the Habersham County Sheriff’s Office had arrived on scene to assist. We then attempted to place Barragan in the rear seat of Ofc. Schoenholz’s vehicle due to the fact that he was now under arrest for Disorderly Conduct 16-11-39.

Barragan stiffened his body and refused to sit in the vehicle. I then placed my left hand on his right should and my right hand to the center of his abdomen and pressed firmly to get him to bend at the hips. While doing this one of the deputies reached through the back seat area from the other side and pulled his arms. Barragan was safely placed in the vehicle at that point. Barragan did kick me int he center of the chest knocking my body camera off of my vest carrier.

Barragan finally calmed down enough for the paramedics to check his vitals while sitting upright int he back of the patrol car. Barragan asked several times for me to release him and I explained to him that we were past that point and I told him multiple times what he was being charged with. Once the paramedics were done with checking him out, I told Barragan to turn in the seat and to put his feet in the vehicle. Barragan became irate again and refused and attempted to stand up. I then pushed him back into the vehicle and grabbed his legs to swing them into the vehicle so I could close the door.

Barragan then kicked at me again knocking my body camera off. Barragan stiffened his entire body laying flat on the seat. I then attempted several times to get his knees to bend. Barragan kicked at me again. I then grabbed his right leg and used a closed hand strike to the inner thigh just above the knee attempting to strike the nerve that runs down the inner thigh in attempt to cause that leg to fold. Barragan kept his leg locked despite the strike.

One of the deputies then drug Barragan back into the vehicle and at that point we were able to close both back doors securing Barragan inside the vehicle. Due to his violent actions Barragan was not seat belted in for the transport to the detention center. Barragan had in his possession, at the jail past the guard line, a clear plastic bag containing what appeared to be marijuana and another clear bag inside with the marijuana which appeared to contain methamphetamine. This would explain why he was refusing to be searched on scene. The items, according to Ofc. Schoenholz were located inside of his underwear.
