On Thursday, October 1 st , 2026, at approximately 2100 hours while investigating a crash with injuries, I encountered Carol Burrell, who was later identified by her Georgia’s Driver’s license. While I was interviewing the parties involved, Ms. Burrell was present with Mr. [REDACTED]. Ms. Burrell was there to help Mr. [REDACTED] who was in the crash. While I was conducting the interview I immediately smelled the smell of an alcoholic beverage and began questioning both Mr. [REDACTED] and Ms. Burrell. Ms. Burrell told me that she drank wine previously in the night approximately two hours prior to arriving. Ms. Burrell stated she had only one glass. I also confirmed Ms. Burrell drove to the crash in the white Ford pickup truck that was parked nearby.

At approximately 2114 hours, I advised Troop B communications that I will be conducting a traffic stop on scene of the crash on Ms. Burrell. I then asked the law enforcement personnel that were assisting with the crash to turn off their flashing lights. I asked Ms. Burrell if she would be willing to participate in Standardized Field Sobriety Tests (SFST) to which she agreed to participate. At approximately 2134 hours I advised Troop B Communications that I would be performing SFTs on Ms. Burrell to investigate the DUI.

After medically clearing Ms. Burrell, I set her up in the proper starting position for the Horizontal Gaze Nystagmus Test and gave her the proper instructions. For my stimulus during the HGN Test, I used my right index finger, which I positioned slightly above Ms. Burrell’s eye level and approximately 12-15 inches away from her face. While administering the HGN Test, I had to instruct Ms. Burrell to keep her head still as well as focus on my stimulus. During the HGN Test, I also observed Ms. Burrell very subtly swaying side to side. I observed four clues present.

I then adjusted my patrol car and made sure my windshield was clear. I then set Ms. Burrell in the proper starting position for the Walk and Turn Test and gave her the proper instructions. While placing Ms. Burrell in the starting position, she decided that she did not want to wear her flip flops so she could better perform the tests. During the instructional phase, Ms. Burrell began too soon and was unable to maintain balance causing her to break from the stance, readjust then place her left foot in front of her right foot, instead of right in front of left like she was instructed. While performing the test, Ms. Burrell missed heel to toe, stepped offline, made an improper turn, used her arms to balance, stopped too soon, and took an improper number of steps. Ms. Burrell miscounted her return steps and towards the end, took a step back then a step forward, taking ten steps instead of nine.

Then, I placed Ms. Burrell into the proper starting position for the One Leg Stand Test and gave her the proper instructions. On Ms. Burrell’s first attempt, she swayed, used her arms for balance, and placed her foot down stopping the test. During Ms. Burrell’s first attempt she did not count out loud like she was instructed and the test lasted approximately ten seconds. During Ms. Burrell’s second attempt, she once again swayed, used her arms for balance, began hopping and placed her foot down. I decided to end terminated Ms. Burrell’s second attempt to stop her from hurting herself. I observed four clues present.

I asked Ms. Burrell for a breath sample to which she refused. I then placed Ms. Burrell under arrest for driving under the influence. I read Ms. Burrell the Georgia Implied Consent Notice for Suspects Age 21 and Over specifying blood. Ms. Burrell refused the stated administered blood test with a verbal no.

After placing Ms. Burrell under arrest, I gave her a chance to have someone pick up her vehicle. After waiting more than thirty minutes and no one showed up I then released Ms. Burrell’s vehicle to Hardmen’s Towing Company.

I then transported Ms. Burrell to the Hall County Jail where she was turned over to jail staff without further incident.
