On 12/20/2025 at about 0425 hours, I Officer Nicely was in line to checkout at the Raceway Convience Store on Hwy 17 Lavonia, Ga. A white male was standing in front of me and I noticed that he was moving very slow and acted lethargic. I asked the clerk did he believe the male was drunk and he said yes. I asked the clerk did he smell alcohol coming from the male and he said yes.
When the unknown male walked out the door I noticed that he was unsteady on his feet and was staggering as he walked towards his truck that was parked at a gas pump. The truck was a white Ford F-150. The male got in the truck. I then walked to my Patrol Unit and waited for the male to see if he would drive off. I looked away for a brief moment and looked back at the pump and the truck was gone. I then drove onto Hwy 17 Northbound where I saw the truck making a left turn from Hwy 17 towards the I-85 Northbound ramp. I activated my emergency equipment and got the truck stopped on the ramp for an investigative stop because I I believe the male was under the influence of alcohol or drugs.
I made contact with a white male driver. I told him why I stopped him and I asked the male for his drivers license and the male fumbled his card holder and the contents came out. I noticed that the male had a Police ID with the Alto Police Department. The ID had the name Noah Hart on it. The male gave me his drivers license and I had dispatch check it through GCIC.
Dispatch said the Hart subject’s license was valid. I noticed when Hart spoke his speech was slow and he had to think about what he was going to say. Sgt. Herring arrived on scene with me and he spoke to Hart and asked him has he been drinking and Hart replied yes he has. Hart said at first two beers and then said he has been drinking a lot because his best friend had a Heart Attack earlier in the day and was at the hospital in Gainesville, Ga. Hart said he was going to see him. Sgt. Herring told me that Hart said he was not going to do any Field Sobriety checks. I told Hart he was on the Northbound ramp not the Southbound ramp to Gainesville, Ga. Hart said his girlfriend told him the same thing when he made his left turn onto the ramp.
I asked Hart to step out of the vehicle. I asked Hart would he be willing to blow into an Alco-Sensor and Hart said he would do anything I asked of him. Hart tested positive. I placed Hart under arrest and cuffed him behind his back, checked the cuffs for proper fit, double locked them. I then searched Hart incident to arrest and Hart requested that I give his Money about $100.00 and his keys and cell phone to his girlfriend [REDACTED] which I did. Sgt. Herring asked Miss [REDACTED] to blow into the Alco- Sensor to see if she was able to drive Hart’s truck to her house. Sgt. Herring said she blew .01 grams. I then walked Hart to the clear rear seat of my Patrol Unit where I had him sit down and I then read Hart the Georgia Implied Consent Warning over twenty one years of age.
I asked Hart would he submit to the State Administered Chemical test of his blood under the Georgia Implied Consent Warning and Hart said yes he would. Sgt. Herring and I seat belted Hart in for safety. I stood by What A Burger where Sgt. Herring went and brought back a GBI Blood Kit. I then transported Hart to the Stephens County Hospital for a legal blood draw. I then transported Hart to the Hart County Detention Center where he was turned over to the Detention Staff. I then wrote a Citation for DUI and had Hart sign it.
