On Tuesday, July 08, 2025, at approximately 1943 hours, I was dispatched to [100 BLOCK] Marlin Terrace in reference to an aggravated assault.

Before arrival, Dispatch advised there was a neighbor dispute at the residence and someone was possibly hit with a base ball bat during a physical altercation.

Upon arrival, I made contact with the victim/offender, James Holley and his 17 year old son, witness [WITNESS #1]. James was sitting on the front porch steps to his residence. When I asked him what happened I could smell the odor of an alcoholic beverage emitting from his person.

James stated he walked across the road to his neighbor’s residence, [100 BLOCK] Marlin Terrace to ask the offender, Jacob Hudgens for help moving a gazebo in his backyard. Jacob and his girlfriend, the witness [WITNESS #2] came over to James’ residence to help him move the gazebo. While they were attempting to move the gazebo James and Jacob got into a verbal argument about how it should be moved.

James stated during the argument he told Jacob “Your a dumb*ss if you don’t think we need to do this.” Jacob got angry and told James not to call him a dumb*ss again. James stated he told Jacob he did not call him a dumb*ss, he stated “Your a dumb*ss if you think this.” Jacob pushed James after the statement was made and James stated they started to fight. During the fight, James stated his son, [WITNESS #1] got a baseball bat to protect him and tried to hit Jacob with it. James was able to restrain Jacob on the ground while they were still fighting. Jacob got away from James’ grasp and went back to his residence. While Jacob was gone, [WITNESS #2] tried to calm James down. James stated both he and Jacob were intoxicated.

Jacob came back to James’ residence with 2 baseball bats and James stated they started fighting again. Jacob swung one of the baseball bats at James trying to hit him. James ducked the first swing and Jacob swung it again hitting James in the back of the head. James took Jacob to the ground again and the witness, [WITNESS #3] took the 2 baseball bats away from the fight. Jacob left the residence again and walked back to his home when 911 was called.

While I was talking to James, he was breathing heavily trying to catch his breath and holding the back of his head in pain where Jacob hit him with the baseball bat.

I verified what James stated to me and he told me he called Jacob a dumb*ss because Jacob wanted to try to move the gazebo with 2 people instead of 4.

I observed James’ injuries and saw a bump forming on the back of his head where Jacob hit him and several minor cuts on his body from the fight. There was blood on James’ chest and I asked if it was his blood. James stated it was possibly Jacob’s blood because of how hard he hit Jacob during the fight.

I tried to verify James’ statement again and he stated after Jacob pushed him, Jacob threw the first punch and started the fight. During the fight James stated he tried to restrain Jacob on the ground but Jacob contentiously punched him while being restrained so James started punching him back. Jacob got away from [JAMES] and walked back to his residence to get the 2 baseball bats. He came back to James’ residence and started fighting James again. During the fight Jacob hit James in the back of the head with the baseball bat. James took Jacob to the ground again and continued to fight on the ground. [WITNESS #3] removed the bats from the fight. James and Jacob stop fighting. Jacob goes back to his residence before my arrival.

Emory EMS provided medical attention for James’ injuries.

I asked [WITNESS #1] what happened and he stated the following. [WITNESS #1] asked his friend, the witness [WITNESS #4] to come help move the gazebo while his father asked Jacob for his help. [WITNESS #1] stated James and Jacob started arguing about how to move the gazebo. James told Jacob that it was “dumb*ssery” they did not need 4 people to move the gazebo. [WITNESS #1] stated when Jacob pushed James he ran inside the house and got the baseball bat. When [WITNESS #1] came back outside, he saw Jacob and James fighting on the ground. Jacob and James stood up off the ground continuing to fight. [WITNESS #1] stated when they got off the ground he had the bat above his shoulder as if he was ready to swing it. [WITNESS #1] told Jacob to go home multiple times and Jacob flinched at [WITNESS #1] with closed fist. [WITNESS #1] stated he was scared Jacob was going to hit him and he reacted in self defense striking him with the bat. [WITNESS #1] hit Jacob in the shoulder with the bat. After [WITNESS #1] hit him, James and Jacob started fighting again. James took Jacob to the ground and restrained Jacob while Jacob continued to hit James. James allowed Jacob to get up and Jacob went back to his home. After Jacob left, [WITNESS #1] stated he went inside his house to calm down.

I made contact with [WITNESS #3] and she stated the following. [WITNESS #3] stated she saw the end of the fight and her son, [WITNESS #4] was helping them move the gazebo. [WITNESS #4] came home and told [WITNESS #3], Jacob and James were fighting. [WITNESS #3] asked [WITNESS #4] what happened. [WITNESS #4] told her while they were trying to move the gazebo, James called Jacob a dumb*ss. Jacob told James not to call him a dumb*ss and James said it again. Jacob pushed James and [WITNESS #4] left.

[WITNESS #3] stated she heard [WITNESS #2] scream and came outside to see Jacob and James fighting in the front yard on the ground. [WITNESS #3] saw the 2 bats laying on the ground and moved them away from the fight. She stated she did not see anyone get hit by a bat or did not know how the bats got there.

I made contact with [WITNESS #4] and he stated the following. [WITNESS #1] asked [WITNESS #4] to help move the gazebo. [WITNESS #4] stated Jacob and James got into an argument about how many people it would take to move it. [WITNESS #4] stated during the argument James stated to Jacob that was a dumb*ss thing to say. [WITNESS #4] told me James did not call Jacob a dumb*ss directly. Jacob told James that if he called him a dumb*ss again he would knock his lights out. James told Jacob all he said was it was a dumb*ss thing to say. Jacob pushed James after the comment was made and [WITNESS #4] left the scene.

After I talked to [WITNESS #4], I made contact with [WITNESS #2] and Jacob in their residence. [WITNESS #2] stated Jacob passed out on the floor. Jacob was yelling he did not pass out and he was okay. Emory EMS was notified and came to provide aid to Jacob.

Jacob was breathing heavily while laying on his back. His face was swollen under his right eye and he was actively bleeding from his nose. Jacob continued to yell and cuss stating he was okay. While EMS was gathering their equipment Jacob started to roll on his left side. He stated hollering in pain and holding his left arm. [WITNESS #2] stated that was the arm that was hit with the baseball bat. [WITNESS #2] pleaded with Jacob to allow EMS to take him to the hospital but he refused to go.

Jacob wanted to tell me his side of the incident. He stated the following. Jacob stated James asked him to help move the gazebo and it was a set up. When Jacob went to help, he told me James continued to call him a dumb*ss. Jacob told James to stop calling him names. Jacob stated James continued to call him a dumb*ss and attacked him. Jacob stated since James attacked him, he went to attack him back. Jacob stated once he attacked James, James yelled to [WITNESS #1] “Now.” [WITNESS #1] hit Jacob in his face and arm with the baseball bat. While Jacob was explaining his side, he started to yell and cuss at EMS for bringing the gurney in the residence. Jacob started getting agitated and refused to talk to me.

I asked [WITNESS #2] what happened and she stated the following. James asked them to help move the gazebo. [WITNESS #2] stated Jacob did not want to help at first and told me Jacob was diagnosed with Schizophrenia. When they went to help James move the gazebo, Jacob asked him where they we’re moving it to and James stated over here dumb*ss. Jacob told James that he asked him for help and Jacob refused to be disrespected. James told Jacob it was not that hard to comprehend and why was he asking dumb*ss questions. Jacob told James to stop calling him a dumb*ss and James refused to stop. Jacob told James if he continued to call him a dumb*ss he would hit him. James continued to call Jacob a dumb*ss and Jacob pushed him. After he pushed James, both of them stood in a fighting stance but did not fight. James told [WITNESS #1] to take his glasses inside and go get it. [WITNESS #1] went inside the residence and got a baseball bat. [WITNESS #2] stated [WITNESS #1] hit Jacob in the arm with the bat before James and Jacob started fighting.

After [WITNESS #1] hit him, [WITNESS #2] stepped in between [WITNESS #1] and Jacob telling him to go inside the house. While she was talking to [WITNESS #1], Jacob and James started fighting. [WITNESS #1] pushed [WITNESS #2] out of the way and hit Jacob again in the mouth with the bat. [WITNESS #2] got in between them again telling [WITNESS #1] to go inside. James was choking Jacob on the ground while [WITNESS #1] went inside the house. Jacob was able to get away from James and walked back to his residence. [WITNESS #2] stated she checked on James because he was bleeding and James was yelling that he had a bone to pick with Jacob. [WITNESS #2] walked back to her residence while James continued to yell and cuss at Jacob from his yard. Jacob walked back to James’ house with a baseball bat. James took the bat from Jacob and started to hit him with the handle end of it in the head. [WITNESS #2] stated she screamed and [WITNESS #3] came outside and tried to break the fight up. [WITNESS #2] stated she took the bat from James and she helped [WITNESS #3] separate them. Jacob came home and we arrived on scene.

[WITNESS #3] and [WITNESS #4] completed a witness statement form that was attached to the report. James and [WITNESS #1] refused to complete a witness statement form because the incident was on body camera.

Jacob was transported to the hospital for his injuries and [WITNESS #2] went with him. I was unable to obtain a witness statement form from her since she left the scene with Jacob.

Corporal Robillard with the Houston County Sheriff’s Office Criminal Investigations Division was notified of the incident.

Pictures were taken of James’ injuries and attached to the report. James refused to go to the hospital by EMS and stated he would go in his personal vehicle.

Warrants were taken on both James and Jacob for affray. Jacob was also charged with aggravated assault. Due to both parties having severe injuries no arrest were made at the time of the incident.
