On August 13th, 2023, at approximately 17:29 hours I was participating in a supervisor approved Road Check on Plainview Road in Jackson County, Georgia when a gray Dodge Dart approach.
TFC Clark #523 and Cadet Hughes #399 spoked with the driver and immediately smelled the strong odor of marijuana emitting from within the vehicle. TFC Clark #523 and Cadet Hughes #399 asked the driver to pull his vehicle off the roadway. The driver complied.
I approached the vehicle after TFC Clark #523, and Cadet Hughes #399 had already asked the occupants to exit the vehicle. I asked the driver who I identified as Wesley Izaac Entrekin by his Georgia Driver’s License to follow me back to my patrol car.
Once in front of my patrol car I observed Mr. Entrekin’s eyes to be extremely bloodshot with severe reddening of the conjunctiva. I also observed the strong odor of marijuana emitting off Mr. Entrekin.
I asked Mr. Entrekin if he smoked marijuana. Mr. Entrekin advised that he does not smoke marijuana. I asked Mr. Entrekin if he had consumed any alcohol. He advised that he had not and that I could “test me if you want.”
I asked Mr. Entrekin if he would freely and voluntarily consent to voluntary field sobriety evaluations. Mr. Entrekin stated, “I consent.”
After medically clearing the driver, I positioned him in front of my patrol vehicle on a flat, paved surface free from obstructions to perform the Horizontal Gaze Nystagmus portion of field sobriety.
I observed the driver’s pupils were equal in size and showed no signs of resting nystagmus. I observed both eyes to track equally. I observed both eyes show lack of smooth pursuit. Distinct and sustained nystagmus at maximum deviation was present in both eyes.
Onset of nystagmus prior to forty-five degrees was present for a total of six out of six possible clues. I observed Mr. Etrekin’s pupils to be dilated.
Next, on the Walk and Turn, I positioned the driver in front of my patrol vehicle on a flat, paved surface free from obstructions. I explained and demonstrated the evaluation.
Mr. Entrekin stated he understood. During the Instructional Phase, I observed the driver place his left foot in front of his right foot rather than his right foot in front of his left foot to get into the instructional position.
During the first set of nine heel to toe steps, I observed the driver raise his arms. The driver performed an improper turn, raised his arms for balance and then stopped walking to regain his balance.
Mr. Entrekin then on the second set of 9 heel to toe steps raised his arms for balance and took 10 total steps. I observed a total of four out of eight possible clues. During the second set of 9 heel to toe steps the driver veered to the right rather than walking down a “straight line.”
Next, on the One Leg Stand, I positioned the driver in front of my patrol vehicle on a flat, paved surface free from obstructions. I explained and demonstrated the evaluation.
I observed the driver use his arms for balance. I observed a total of one out of four possible clues. The driver did not count in the correct manner. Driver did not look at his elevated foot. Driver did not keep his leg straight. Driver leaned back throughoit the evaluation.
Next, I checked to see if the driver’s eyes would converge on a stimulus. I observed both eyes show a lack of convergence.
Finally, I performed the Modified Romberg evaluation where the driver was instructed to estimate the passing of thirty seconds. Mr. Entrekin’s internal clock registered 36 seconds. Mr. Entrekin said “Stop” at 39 seconds but did tilt his head forward at 36 seconds.
After I concluded administering the field sobriety evaluations to Mr. Entrekin, I again asked him what type of drugs he was using. Mr. Entrekin advised that he does not do drugs.
I placed Mr. Entrekin under arrest for Driving While Under the Influence at approximately 17:40 hours. I read Mr. Entrekin Georgia’s Implied Consent Notice for suspects under the age of 21 requesting blood and the driver agreed at approximately 17:42 hours. I placed Mr. Entrekin in the rear of my patrol vehicle.
While I was conducting SFST’s on the driver, TFC Clark #523 conducted a probable cause search on Mr. Entrekin’s vehicle. The search revealed two plastic bags containing a green leafy substance along with a Bong that was located under the driver seat.
TFC Clark #523 also located a Budwieser in the passenger floorboard along with a handgun that the front seat passenger claimed as his. I identified the front seat passenger of the vehicle to be Mr. Michael Wayne Murphy by the name and date of birth that he provided to me.
I identified the back seat passengers as [JUVENILE #1] and [JUVENILE #2] by the names and dates of birth that they provided to me. None of the occupants claimed the marijuana or the bong.
TFC. Clark #523 located a THC Vape Pen containing Liquid THC on Mr. [JUVENILE #1]’s person. All of the occupants of the vehicle had bloodshot eyes with severe reddening of the conjuctiva.
I placed Mr. Murphy under arrest for possession of marijuana less than an ounce, possession of a drug related object and for underage possession of alcohol because the Budweiser was at Mr. Murphy’s feet.
I placed Ms. [JUVENILE #2] under arrest for possession of marijuana less than an ounce and possession of a drug related object. Ms. [JUVENILE #2] was released to her Grandmother after a Juvenile Complaint form was completed.
Mr. [JUVENILE #1] was arrested for possession of marijuna less than an ounce, possession of a drug related object, and possession of a controlled substance.
TFC Clark #523 had a field test kit available and confirmed the Vape pen found on Mr. [JUVENILE #1]’s person was liquid THC. Mr. [JUVENILE #1] was transported by SGT Sanders #369 to meet Mr. [JUVENILE #1]’s father who Mr [JUVENILE #1] was released to after a juvenile complaint form was completed.
Mr. Entrekin’s vehicle was removed from the scene by Curt’s towing. I transported Mr. Murphy and Mr. Entrekin to the Jackson County Jail where Mr. Murphy was released to the jail’s staff for processing.
I led Mr. Entrekin to the jail’s medical room where I completed the voluntary blood draw at approximately 20:00 hours. I sealed each vial and placed them in the GBI Blood kit as Mr. Entrekin watched carefully as I filled out all of the information.
Mr. Entrekin was then turned over to the jail’s staff. Mr. Entrekin was charged with Driving While Under the Influence, Possession of Marijuana Less than an Ounce, and Possession of a Drug Related Object.
I transported the GBI Blood Kit along with all other evidence to Post 32 Athens, where it was submitted into the Evidence Bin.
