I responded to a hit and run accident on New Clinton Rd near Sunvalley Rd. While en route dispatch informed me that the offender vehicle could possibly be a Honda Pilot or black SUV.

Upon arrival I noticed that the victim and the witness were the two individuals that were walking to the store earlier that Deputy Langston and I got out with to check on. The individual that was struck by the vehicle was [VICTIM #1]. He was laying in the ditch on his side with blood on his face. He was complaining of pain all over his body. He was knocked in the air out of his shoe that was on the side of the road. [VICTIM #1] was transported to the hospital by Ambulance.

[WITNESS #1] the relative and witness to this incident stated that he had his phone light on so that they could be visible to the very few motorist on this road this time of morning. I noticed a rear view mirror from the passenger side of the offenders vehicle on the side of the road near the victim. I also photographed and collected a passenger side fog light cover to the offender vehicle. After looking at the broken mirror I noticed a Toyota symbol and part numbers. I goggle searched the part numbers and discovered that the part belonged to a Toyota 4 Runner.

I conducted a Flock camera search for the past 48 hrs and noticed a few 4 Runners that passed by the New Clinton camera. I ran the license plates on the 3 black 4 Runners an got three possible address. One of the address came back to [100 BLOCK] John Michael Dr. I went to that location and noticed a black 4 Runner [REDACTED] with a missing passenger mirror and passenger side damage.

The driver who was identified as Giovanni Nunez was passed out behind the wheel. There were several open containers of Alcoholic beverages inside of the vehicle. The hood wa still hot even on this cool night/morning. There were several strands of black hairs on the dented A Post on the passenger side of the SUV. The victim had Dreads (long black hair). I matched up the broken car parts that were on scene with the offender vehicle and they matched perfectly.

I read the offender Miranda and he stated to me that he had been drinking at a friends house on Bass Rd and he drove home an hr prior to our encounter which was the exact time of the Hit and Run. Nunez stated to me that he did not even realize that he was missing a mirror. He also denies hitting anyone. Nunez stumbled and almost fell down as he walked to my patrol car. I instructed Nunez to lean on my Push Bumper so that he would not fall down. Nunez speech was slurried and slow, and his breath smelled like an alcoholic beverage.

Based on my knowledge training, and experience. Nunez was intoxicated and was unsafe to be operating a vehicle during the time of the accident. Nunez stated that he had been passed out for an hour and in his vehicle this time frame. The vehicle was still hot. His conduct was reckless as well as his driving. John Michael Drive where Nunez live was in close proximity of the Hit and run location. base on the totality of the circumstances Nunez was arrested and charged with this incident.
