On this date, I met with [VICTIM #1] at the Jones County Sheriff’s Office regarding a sexual battery complaint.

Ms. [VICTIM #1] stated the incident occurred at her husband’s uncle’s house located at [700 BLOCK] Fortville Milledgeville Road. She further identified Robert Miller, her husband’s uncle, as the offender.

Ms. [VICTIM #1] stated they had all gone to Miller’s house on Saturday 9/20 for a family gathering. Miller’s mother is a resident at Autumn Lane, but they had brought her to the house to spend time with the family for her birthday. [VICTIM #1] stated Miller had been drinking during the day and wanted to take his mother down to a pond on the property, but due to her medical issues, they were unable to get her there. She said Miller became angry and at that point everyone decided it was time to leave. She went back home at that point.

Later in the evening, her mother-in-law, [REDACTED], sent a message in a group chat asking for help caring for their nanny. [VICTIM #1] is a caregiver during the day for an elderly man, so she went to help her [REDACTED] take care of nanny. Once she got back to the house and they got nanny taken care of for the night, [REDACTED] told [VICTIM #1] she was going to take her mediciations and go to bed. [VICTIM #1] stayed there with nanny and says she dozed off. She later woke up to Robert Miller on his knees in front of her. She said he had his hands inside the legs of her shorts reaching up towards her hips, touching her thighs. [VICTIM #1] had a Stanley cup which she used to strike Miller several times to get him off of her. She says she tried to wake up their nanny but could not get her to wake up. [VICTIM #1] said she called her husband and told him what happened and he advised her to leave. She said she was trying to get out of the house when Robert grabbed her arm. She said she hit him again with the cup to get him to let go of her. She said her husband was still on the phone with her when this happened.

[VICTIM #1] said she left the house and returned home. She has not heard from Robert since the incident. Her husband, [WITNESS #1], went back to the house on Sunday during the day to help get nanny loaded up to go back to Autumn Lane. He did not see Robert at the house while he was there.

I explained to [VICTIM #1] that I would likely be taking a warrant on Robert for Sexual Battery and explained she may be contacted by the DA’s office going forward. I also provided her with information for Crisis Line and Safe House if she feels that she needs a protective order.

I contacted [WITNESS #1] and he confirmed he did receive a phone call from [VICTIM #1] around 3am on Sunday morning. He said he it took him a little bit to wake up to realize what she was saying, but she told him that she woke up to Robert touching her thighs and she was trying to get out of the house. He said he did not hear Robert in the background but only heard [VICTIM #1].

Warrant for Sexual Battery (misd) submitted to Judge Patterson for approval on this date.
