Deputies and Officers responded to a 911 call of a dog being drug by a van traveling south on Veterans Parkway. I Deputy Mason and Deputy Lester noticed the van in question on the side of the road with several people yelling at the driver of the Van.
Deputies made contact with the driver of the van and asked him to step out of the vehicle. As the driver stepped out of the vehicle I could smell the odor of an alcoholic beverage coming from the driver. When the driver exited out of the vehicle he said he forgot the dog was behind the vehicle and he was sorry. I conducted a pat down for weapons and placed the driver into the back seat of my patrol vehicle. I then advised dispatch to start animal control for the dog and Franks to tow the vehicle.
Deputy Lester informed the driver that he was under arrest placed him in handcuffs and put him in the back of his patrol vehicle. Deputy Lester transported the driver to the Lamar County Detention Center. I told Deputy Lester to read implied consent because based on the smell of alcohol, his sway when he walks and his speech slurred more than usual as I am familiar with the driver. Deputy Lester reported to me that the driver said he would not submit to states test and that he was sorry he forgot the dog was behind the van.
When animal control arrived and captured the dog you could see several open wounds on the dog that were fresh and bleeding. Animal control transported the dog to the county animal shelter and Franks impounded the van.
