On 04/30/2026 I, Deputy Whitaker, assited with a traffic stop on a gray Volkswagon Passat on I-16 near MM60.
Before my arrival, I spoke with Cpl. Zuckerman, who stated that he could smell the odor of marijuana emanating from within the vehicle. When I arrived, I spoke with the driver and also noticed the odor of marijuana. The driver, Dawainjalene McGhee, stated that there was no marijuana in the vehicle but said she smoked marijuana prior to driving at her home in Macon. I asked McGhee to step out of the vehicle. I then asked McGhee to participate in SFST and ARIDE to which she agreed. During ARIDE, I observed the following indicators:
Medical Indicators: McGhee stated that she had blurry vision and couldn’t see well without her glass, however, she did confirm she could see and follow the stimulus. McGhee also stated she had a scooter accident that affects her balance, but demonstrated she could balance by standing on one leg.
Convergence test: McGhee was able to track the stimulus but lacked smooth pursuit. A lack of convergence was noted with McGhee’s eyes only moving slightly inward with the stimulus before returning to a resting neutral position.
Finger to Nose: McGhee missed touches 1 and 6
Romberg Balance: McGhee failed to follow initial instructions and estimated the passing of 30 seconds in 18 actual seconds.
Due to dangerous traffic conditions I declined to continue with SFST and asked McGhee to participate in a breath test. McGhee agreed to the test and the results were a 0.078. During the test I also noted the odor of an alcoholic beverage emanating from her breath. While conducting ARIDE and the breath test, Cpl. Zuckerman searched the vehicle on probable cause and located less than one ounce of marijuana rolled into a “joint” and an open container of wine.
Based on indicators observed and evidence at the scene, I placed McGhee under arrest for DUI. McGhee was read and agreed to the Georgia Implied Consent Notice. McGhee was transported to the Laurens County Jail where, as a qualified law enforcement phlebotomist, I made a successful blood draw. The evidence was sealed in the supplied GBI kit and turned in to evidence. McGhee was turned over to jail staff.
