On 12/14/2021 at 1112 hrs, I was dispatched to [200 BLOCK] Magnolia Plantation court in reference to a domestic in progress. Central advised the complainant stated it was physical and she was able to get her husband out of the home.
When I arrived on scene, I observed a black male standing on the porch outside of [200 BLOCK] Magnolia Plantation court gathering his belongings. I made contact with the male, Mr Aldridge Murrell and asked what was going on. He stated he got into an altercation with his wife, Ms [VICTIM #1] and she told him to get out so he was just gathering his belongings to leave.
Lt Dill (162) arrived on scene to assist me and made contact with Ms [VICTIM #1] inside the home.
I asked Mr Murrell what the altercation was about and he stated he just returned from Korea where he was stationed at for the last year. He stated Ms [VICTIM #1] was telling him that he was a bad father and he has not been there for their son, [REDACTED]. I asked if at any point during the altercation if things got physical or if items were thrown around and broken. Mr Murrell stated “I do not want to say that because I believe the child should have both parents in his life”.
At this time, I stopped the interview and read Mr Murrell the miranda warning from the card that was issued to me by the Hinesville police department. Mr Murrell stated he wished to continue to speak to me.
I told Mr Murrell I understand his concerns for wanting both parents to be in the child’s life however, we want to make sure the child is safe. Mr Murrell stated he understood and that things did get physical at one point during the altercation. He stated he walked out the room with his glass of milk when he felt a hand on his back so he smacked it away. He stated Ms [VICTIM #1] was yelling for him to “get the f*ck out” and was pushing him several times causing the milk to spill. He stated that it did not get physical beyond that point. He stated he gathered his belongings to go stay elsewhere.
I had Mr Murrell stand by outside with S/CPL Shin while I entered the home to speak with Lt Dill and Ms [VICTIM #1]. When I walked in the front door I saw Ms [VICTIM #1] was upset and trying not to cry while holding their 5 month old son. Lt Dill was explaining the process on how to obtain a temporary protection order (TPO) because Ms [VICTIM #1] was in fear that things would get worse between her and Mr Murrell.
Stepped outside with Lt Dill who stated Ms [VICTIM #1] told him she was not feeling well so she asked Mr Murrell to watch their son so she could lay down for a little bit. She told Lt Dill Mr Murrell came into the bedroom and laid the baby down on the bed next to her when he continued an arguement with her. She stated Mr Murrell got on top of her with his legs straddled over her left leg and used both of his hands to hold her down on the bed by placing them on her chest.
I went downstairs to Mr Murrell, who was sitting in his vehicle, and told him that his rights are still in effect and he does not have to answer further questions if he so chooses. I asked Mr Murrell if at any point during the altercation if he climbed on top of Ms [VICTIM #1] and held her down on the bed, to which he responded “no that never happened”.
Lt Dill was back inside the home speaking with Ms [VICTIM #1]. I went inside and Lt Dill was speaking with Ms [WITNESS #1], who also resides in the home and Ms [VICTIM #1]. Ms [WITNESS #1] was stating she observed Mr Murrell blocking her daughter (Ms [VICTIM #1]) from exiting the room even after she stated numerous times for him to let her out and would move side to side, matching her movements (Ms [VICTIM #1]’s) blocking her from leaving.
I spoke with Ms [VICTIM #1], who stated her husband came into the bedroom and sat their 5 month old son on the bed next to her where she was laying down. She stated Mr Murrell started to argue with her when he climbed on top of her and was holding her down on the bed. Ms [VICTIM #1] stated she had to kick Mr Murrell to get him off of her and the only time she pushed her husband (Mr Murrell) was when he would not let her out of the room. She stated one of the times she pushed her husband (Mr Murrell) to get out of the room, he had a glass of milk in his hands and that’s how it got spilled.
I spoke with Ms [WITNESS #1], who stated she was in her room, working, when she heard Ms [VICTIM #1] yelling for help and for Mr Murrell to get off of her. She stated when she walked to their bedroom, she observed Mr Murrell standing over Ms [VICTIM #1] who was sitting on the bed with [REDACTED] in her arms. She stated Mr Murrell was yelling that he was going to remove everything from the home and leave. Ms [WITNESS #1] stated she told Mr Murrell that the items in the home such as the tv is shared property because they were married so he should only take his personal belongings for now. She stated Mr Murrell would leave the bedroom and come back approximately 3 to 4 times and each time Ms [VICTIM #1] would try to leave the room and Mr Murrell would stand in front of the door and move in front of Ms [VICTIM #1] to keep her in the room, even though she was yelling for him to let her out the room. She stated Ms [VICTIM #1] would had to use her body weight with the child in her arms to push by Mr Murrell, so she could exit the room.
I provided Ms [VICTIM #1] with a CRN and a victims phamphlet with instructions on how to obtain a copy of this report.
I went outside and had Mr Murrell turn around and place his hands behind his back, to which he complied. I told Mr Murrell he was being placed under arrest for simple battery-FVA and false imprisonment. Mr Murrell was placed in handcuffs, double locked and checked for fit. I searched Mr Murrell incident to arrest with no contraband found. Mr Murrell was placed in the rear seat of officer Jessen’s (145) patrol vehicle, which was checked for contraband before transport with no contraband found, seat belted in and transported to liberty county jail. Mr Murrell was released to the jail staff without incident.
I will apply for the arrest warrants for simple battery-FVA and false imprisonment. My department issued BWC was active for the duration of this call.
