Officer’s Narrative:

On Sunday, November 21, 2021 at approximately 2014 hours, I was patrolling the area of Ga, 38 near Old Gress Island Dr. I noticed a White car pull onto Ga 38, from Old Gress Island Rd. The vehicle had no headlights, or tail-lights on. I drove behind the vehicle and as we approached Martin rd. the vehicle’s headlights and tail-lights came on. I followed the vehicle, approaching Ga 38 and HWY 17. I observed a black cover around the license plate on the rear of the vehicle. The sticker decal in the bottom left corner was partially covered by this cover. I was unable to determine if the registration was expired or not because of this. All I could see was the month of November, but could not see the year or the color of the decal.

I attempted the run the tag (GA TAG:[REDACTED]) through my mobile data terminal (MDT) through GCIC to see if the tag was expired or valid. My computer did not generate a response for a few. I was unable to determine if the tag was expired or not. I conducted a traffic stop on the vehicle as we approached Dasher Rd. I used my emergency equipment to do this. The vehicle stopped in front of Mr. Pizza on Ga 38.

I approached the vehicle on the driver side and spoke to the driver, Ms. Amber Mikell. I immediately could smell the odor of an alcoholic beverage emitting from the vehicle. I explained to Ms. Mikell the reason for the stop. I requested the registration and her driver’s license. Ms. Mikell explained she did not have her driver’s license on her, but her license was valid. I asked her if she had anything in the vehicle with her name on it. She supplied a debit card, where I wrote her name down from it. She provided my her date of birth.

I asked Ms. Mikell again for the registration. After a few times asking for it, she supplied it to me, where I could verify the vehicle’s tag was up-to-date. I asked Ms. Mikell to step out of the vehicle. I was observing bloodshot glassy eyes. Her speech was slurred, and I wanted to see if the alcoholic beverage odor was emitting from her.

Ms. Mikell stepped out to the rear of her car. I could smell an alcoholic beverage emitting from her person, and breath as she spoke. I asked Ms. Mikell how many alcoholic beverages she had today. She explained 2 shots about a hour ago. I asked her if she would submit to standardized field sobriety tests. She agreed. I medically cleared Ms. Mikell checking for equal pupil size and equal tracking. I also checked for any resting Nystagmus, which none was present. These were my findings:

  • Horizontal Gaze Nystagmus Test-4 clues
  • Lack of smooth pursuit-both eyes
  • Distinct and sustained Nystagmus at maximum deviation
  • Walk and Turn test-2 clues
  • Cannot balance during instructional phase
  • Improper turn
  • she did no follow directions but not counting her steps out loud
  • One-Leg stand-2 clues
  • Used arms for balance
  • Put foot down

I asked Ms. Mikell if she would submit to a preliminary breath test, to which she refused. I then placed Ms. Mikell under arrest for the suspicion of DUI. I placed her in double-locked handcuffs that were checked for fit. She was searched incident to arrest with no contraband being found. She was seated in the rear of my patrol vehicle which was searched before and after transport with no contraband being located. I read Ms. Mikell Implied consent for ages 21 and over from my green card for blood, to which she agreed.

Ms. Mikell used her cell phone to call a friend to take possession of her vehicle, as the other passengers were to intoxicated to drive. Officer Stender with Midway Police Department stayed with the vehicle until Mr. [REDACTED] arrived to take possession of the vehicle.

I transported Ms. Mikell to the liberty Regional Medical Center for the blood draw, where nurse [REDACTED] drew the blood. While walking into the lab at the hospital, Ms. Mikell spontaneously uttered, I did lie to you, I had more than 2 shots. Throughout the transport, she kept telling me she was caught again and should have known better.

After the blood draw, I transported Ms. Mikell to the Liberty county jail, where she was turned over to jail staff. The blood kit was filled out on property tracking form 9376 and was placed into evidence locker 4. Nothing further at this time.
