Officer’s Narrative:

On Saturday December 25, 2021, at approximately 2020 hours, I was contacted by Deputy Blair to assist a traffic stop where she believed the driver to be possibly under the influence of alcohol. Upon my arrival, I asked Deputy Blair what she observed. Deputy Blair advised me she was traveling east on Ga 38 in the inside lane of travel. She stated observed a white Nissan Maxima with a Georgia license plate of [REDACTED] traveling in the same direction just west of Lewis Frasier Road. She observed the vehicle did not have properly functioning tag lights.
She conducted a traffic stop on the vehicle using her emergency lights and sirens. The vehicle came to a stop on Ga 38 just east of Lewis Frasier Road. She conducted a driver’s side approach to the vehicle. She identified herself and advised the driver of the reason for the traffic stop. She stated she requested the driver of the vehicle to display his driver’s license. The driver was identified as Mr. Jackson by his Georgia driver license’s. She stated could smell a strong odor of an alcoholic beverage emitting within the vehicle while talking to Mr. Jackson.
After Deputy Blair briefed me of the incident, I made contact with Mr. Jackson, who was still located in the driver seat of the vehicle. I conducted a driver-side approach to the vehicle. I identified myself and asked Mr. Jackson if he had consumed and alcoholic beverages today. He stated no. Mr. Jackson was drinking Propel water while I was talking to him. I instructed Mr. Jackson out of the vehicle and to the front of Deputy Blair’s patrol vehicle. When Mr. Jackson attempted to exit the vehicle, he forgot to unfasten his seat belt. As Mr. Jackson was walking to the front of Deputy Blair’s patrol vehicle, he was unsteady on his feet and swaying.
While talking to, Mr. Jackson, I could smell a strong odor of an alcoholic beverage emitting from his breath his eyes were blood shot and watery. I advised Mr. Jackson I could smell the odor emitting from his breath while talking to him. I asked him again if he had consumed any alcoholic beverages today. He stated he drank three 16 ounce Budlights at approximately 1600 hours. Mr. Jackson speech was slurred and very broken. He was swaying side to side while communicating with me.
I asked Mr. Jackson if he would consent to Field Sobriety Evaluations at this time and he stated yes.
Mr. Jackson stated he did not wear contacts or have any eye or head injuries. He also advised me that he had no issues with his legs or back that would prevent him from completing evaluations.
The first evaluation I conducted was the Horizontal Gaze Nystagmus. Mr. Jackson’s pupils were of equal size and both eyes tracked equally on the stimulus (my finger). I observed lack of smooth pursuit, distinct and sustained Nystagmus at maximum deviation. He showed no signs of vertical Nystagmus. (4 out of 6 clues)
The second evaluation was the walk and turn. Mr. Jackson was given verbal instructions and also given a demonstration. He gave a verbal “yes” stating he understood the directions. During this evaluation, I observed Mr. Jackson was unable to keep his balance during instructions, He started to soon, miss several heel to toe steps, conduct an improper turn, steped off the line, use his arms for balance, took the incorrect number of steps and stops while walking. (2 instructional clue and 6 walking clues. 8 total clues)
The third evaluation was the one leg stand. Mr. Jackson was given verbal instructions and also given a demonstration. He gave a verbal “yes” stating he understood the instructions. During this evaluation, I observed Mr. Jackson use his arms for balance, sway while balancing and put his foot down several times. He also did not remain in the starting position. (3 clues).
I used my Department issued PRELIMINARY BREATH TEST (Alco-Sensor III) device to see if Mr. Jackson had a positive reading for alcohol on his breath. Mr. Jackson agreed to give a breath sample using the (PBT). The results indicated a positive result of 0.140.
Based off of my observations and the admission of alcohol consumption before driving, I placed Mr. Jackson under arrest in double-locked handcuffs which were checked for fit. I searched him incident to arrest and no contraband was found. I escorted him to the rear passenger’s side of my patrol vehicle. He was placed in the back seat. The rear seat of my patrol vehicle was searched prior to the beginning of my shift, with no contraband found. I read Mr. Jackson the Georgia Implied Consent Notice for Suspects Age 21 or over, from my green implied consent card on scene. Mr. Jackson verbally consented to the Georgia state administered test of his breath.
I searched the wingspan of Mr. Jackson’s vehicle (passenger compartment) for open containers. I located a clear solo cup in the passenger door compartment that was cool to touch. It contained a goldish red liquid that smelled like beer. Mr. Jackson stated that was from earlier that he was not drinking while driving.
I allowed Mr. Jackson the opportunity to have someone retrieve his vehicle. Mr. Jackson wife was not able to drive due to consuming alcoholic beverages also. The vehicle was released to Ms. [REDACTED] who had a valid Georgia driver license ([REDACTED]).
I transported Mr. Jackson to 11648 E Oglethorpe (Midway Sub Station). Upon arriving at Midway Sub Station Deputy Recore administered the Intoxilyzer 9000 SN# 90-001874. Mr. Jackson gave two breath samples (.115 grams and .115 grams).
I transported Mr. Jackson to the Liberty County Detention Center for further processing. Mr. Jackson was turned over to jail staff without incident. He was issued one citation 1) Driving under the influence of alcohol. He was issued two warnings for defective equipment and open container. The rear seat of my patrol vehicle was searched prior to leaving the jail with no contraband being found. My body-worn camera was active during this incident.
I completed DDS 1205 form and attached Mr. Jackson license to it in the top left corner. I also attached a temporary driving permit to Mr. Jackson copy of the DUI citation. The DDS 1205 form was signed and dated by Mr. Jackson
