Officer’s Narrative:

On December 1, 2021 at approximately 0046 hours, I was stopped on the shoulder of Hwy 196 just east of Willie Dixon Road after completing a traffic stop. I observed a black Ford Taurus (KY tag: [REDACTED]) traveling westbound on Hwy 196 pass my location with dark window tint. A traffic stop was initiated on the vehicle, with the vehicle stopping in the turning lane on GA 38 just east of McIntosh Lake Road. Deputy Davis arrived on scene.

Upon approaching the vehicle, I had the driver let down the driver’s side rear window on the vehicle. I placed my tint meter on the window with a reading of 12% which I had the driver look at and tell me. I then requested a driver’s license from the driver. He stated he did not have his license with him. I requested an identification card and he did not have one with him. I asked the driver for his name and date of birth. The driver stated his name was Brandon Evan Johnson with a date of birth of 5/28/1985. I requested the front seat female passenger’s driver’s license and she presented a Kentucky driver’s license. While standing at the driver’s window, I observed the odor of marijuana emitting from within the vehicle. I returned to my patrol vehicle.

I conducted a status check of the driver’s license and wanted status via my in car computer and dispatch. My search returned with no driver found. I also conducted a status check of the front seat passenger’s license and wanted status via my in car computer. She had a valid license and was not wanted. I had Deputy Davis remove the driver from the vehicle.

I exited my patrol vehicle and spoke with the driver briefly. I had Deputy Davis conduct a frisk of the driver and no weapons were located. I returned to the vehicle and had the female passenger exit the vehicle.

Upon arriving at the front of my patrol vehicle, I asked the occupants if there was any marijuana inside the vehicle and they both stated no. I conducted a search of the driver’s person and no contraband was found. I then began searching the vehicle. Cpl. Lesinski arrived on scene.

I located a green loose substance underneath the driver’s seat which appeared to be marijuana. I then located the driver’s wallet in the sun visor. The wallet contained his identification card which identified him as Brandon Evan Parker with a date of birth of [REDACTED]. I continued my search briefly before proceeding back to Mr. Parker.

Mr. Parker was placed under arrest in double locked handcuffs which were checked for fit. He was placed in the rear seat of my patrol vehicle. The rear seat of my patrol vehicle had been searched after my last transport and no contraband was found. I proceeded back to the vehicle at this time to continue my search. Deputy Davis assisted me. Cpl. Lesinski had conducted a search of Ms. Fortson and no contraband was located.

Deputy Davis located a ball of a green leafy substance believed to be marijuana, in a towel on the middle rear floorboard. He then located a clear plastic bag underneath the front passenger’s seat. The bag contained a green leafy substance believed to be marijuana. He also located another clear plastic bag in the glove compartment. The bag also contained a green leafy substance believed to be marijuana. Ms. Fortson was placed under arrest (in double locked handcuffs which were checked for fit by Cpl. Lesinski) at this time. She was placed in the rear seat of Cpl. Lesinski’s patrol vehicle for transport. The rear seat of Cpl. Lesinski’s patrol vehicle was searched prior to placing Ms. Fortson in it and no contraband was found.

I placed the suspected marijuana on the front seat of my patrol vehicle. The driver stated the marijuana belonged to him and said we could let his wife go, without being questioned. No other contraband was found in the vehicle. Detective Winchell arrived on scene after I spoke with her via phone. During this time, the driver stated to me he wanted to wait to claim the marijuana to see if his wife would claim it.

Detective Winchell spoke to the occupants and advised me to take both of them to jail.

Mr. Parker and Ms. Fortson were transported to the Liberty County Detention Center for further processing. An inventory was conducted of the vehicle and it was towed by the next list wrecker service, Clark’s II. I searched the rear seat of my patrol vehicle after transport, and no contraband was found. Cpl. Lesinski searched the rear seat of her patrol vehicle after transport, and no contraband was found. Mr. Parker was cited for window tint violation, driving with a suspended license, and giving false information. Detective Winchell will be securing warrants against Mr. Parker and Ms. Fortson for possession of marijuana (felony).

The evidence was turned over to Detective Winchell on scene.
