On 02/19/2022 officer Thomas (147) requested officers at 735 E Oglethorpe highway due to a possible intoxicated driver. Upon arrival I made contact with officer Thomas who stated the driver pulled into the paring lot and fell asleep with the vehicle running. He woke the driver up and the driver rolled down the back driver side window and fell back asleep.
I made contact with the driver who was asleep in the driver seat. When I knocked on the window he woke up. I told him to roll down his driver window. the driver rolled down the back driver side window and fell back asleep. I knocked on the driver window again and told the driver to roll the driver window down. He laughed and rolled the back driver window up. After continued attempts to get him to roll down the driver window, the driver rolled it down just a small amount and refused to roll it down any more.
I then instructed the driver to unlock the driver door. The driver then rolled the back driver window down and then all the way back up. I again instructed him to unlock the driver door. The driver attempted to press the unlock button on his driver door panel but he could not push it successfully due to missing the button multiple times and pressing the door panel instead.
The driver removed the keys from the ignition and unlocked the vehicle door using the electronic key fob on his key ring. I opened the driver door and instructed the driver to step out of the car. The driver exited the car and I could smell the odor of an alcoholic beverage coming from his breath and person. There was also an open bottle of patron tequila sitting in the passenger seat. At this time he provided me his Georgia id card and identified himself as Mr Byron Johnson.
I then asked Mr Johnson if he had been drinking and he replied that he had. I asked him how much and he replied ” four shots”. Mr Johnson stated that he had been at his friend’s house on Bradwell street and he went to waffle house because he was hungry. When he got there he fell asleep. Mr Johnson stated he believed he was asleep for around 25 minutes.
I provided Mr Johnson’s information to Lt Boucher (124) who ran it through GCIC/NCIC and his license came back suspended for a previous DUI.
I placed Mr Johnson under arrest for driving under the influence, driving on a suspended license and possession of an open alcohol container. I then read Mr Johnson the Georgia implied consent notice for suspects age 21 or over (green card), and requested a breath test to which he agreed.
Mr Johnson was handcuffed behind the back, double locked and checked for fit. He was placed in the backseat of my patrol vehicle and seatbelted in prior to being transported to the Hinesville police department. Lt Boucher administered an alcohol breath test on the intoxilyzer 9000 which showed a bac of 0.108 grams.
Mr Johnson was citied for DUI (over 0.08 grams), driving on a suspended license 1st offense, and possession of an open alcohol container, with a total bond of $2105.00 and a court date of march 16th, 2022.
Mr Johnson was transported to the Liberty county jail by ofc Santiago (160) in accordance with department policy.
