On 11/27/2021 at 0120 hours, I was parked across from Frozen Paradise and observed a black Dodge Charger (GA Tag [REDACTED]) leave and turn right onto EG Miles Pkwy. Before the vehicle reached the light at Veterans Pkwy, I heard the engine of the vehicle rev up and observed the vehicle doing a burnout. The rear of the vehicle was sliding left to right in the lane and then the vehicle veered onto Veterans Parkway.
I managed to get behind the vehicle which appeared to be traveling at a high rate of speed in the #2 lane. There was also a blue Chevrolet Caprice in the #1 lane and it also was traveling at a high rate of speed. It looked as though the 2 vehicles were racing.
I activated my RADAR unit and the Dodge Charger registered at 77 MPH in a 45 MPH zone. I activated my emergency equipment in order to initiate a traffic stop. I approached the driver, later identified as Mr. Cory Phillips and explained the reason for the stop. I requested his driver’s license from him and he complied. While speaking with Mr. Phillips, I noticed his eyes were droopy and his speech was slurred. I also could smell the odor of an alcoholic beverage coming from his breath. I asked if he had consumed any alcoholic beverages. Mr. Phillips stated he had a some beer while at Frozen Paradise. I asked him to step out at this time. While exiting the vehicle, I could see that Mr. Phillips was unsteady on his feet. His motions appeared to be slow and he had a glazed over look. I asked Mr. Phillips if he would consent to field sobriety evaluation. He stated “Yes” and I escorted him to the evaluation area.
I asked Mr. Phillips if he wore contacts or glasses and he stated he did not. I also asked Mr. Phillips if he had any issues walking or standing that would prevent him from completing the evaluations. He stated no issues.
The first evaluation I conducted was the Horizontal Gaze Nystagmus. Mr. Phillips pupils were of equal size and both eyes tracked equally on the stimulus (my finger). Mr. Phillips again stated he did not wear glasses and could see the stimulus. Both eyes displayed lack of smooth pursuit and distinct and sustained Nystagmus at maximum deviation, and Nystagmus onset prior to 45 degrees. Mr. Phillips would sway back and forth while conducting this evaluation. There were no signs of vertical Nystagmus. With these clues I chose to continue evaluations. (6 out of 6 clues)
The second evaluation was the walk and turn. Mr. Phillips again stated he had no injuries that would preclude him from completing the evaluation. Mr. Phillips was given verbal instructions and also given a demonstration. He gave a verbal “yes” stating he understood the directions. During the evaluation I observed Mr. Phillips unable to keep his balance during instructions, step of the line, use his arms for balance, conduct an improper turn, stop when walking, take the incorrect number of steps, and miss several heel to toe steps. Mr. Phillips did not count his steps out loud as he was instructed to do so. (1 instructional clues, 6 walking clues. 7 total clues)
The third evaluation was the one leg stand. Mr. Phillips was given verbal instructions and also given a demonstration. He gave a verbal “yes” stating he understood the instructions. During this evaluation, I observed Mr. Phillips unable to stay in the starting position, sway when balancing, put his foot down, and use his arms for balance. (3 total clues)
I requested Mr. Phillips to provide a breath sample in my Portable Breath Tester. Mr. Phillips agreed to provide a sample. The PBT showed a positive result for alcohol (.091). Mr. Phillips was then placed under arrest. I searched, handcuffed, double-locked, checked for fit and placed into my patrol vehicle. I then read Implied Consent for persons over 21 to Mr. Phillips and requested breath. Mr. Phillips agreed to provide a breath sample.
I allowed Mr. Phillips to make a phone call to see if someone could pick up the vehicle. Mr. Phillips was able to reach a friend and the vehicle was picked up. I transported Mr. Phillips to Liberty County Jail (in a seatbelt) and prepared the Intox 9000 machine by having it warm up and complete all diagnostic tests. Mr. Phillips was then instructed on how to complete the samples.
Mr. Phillips provided his first sample (.092 BrAC) and exited the room. The Intox 9000 then completed another set of diagnostics and Mr. Phillips provided his second sample which was .087 BrAC per 210L of breath.
I escorted Mr. Phillips back to the booking officers and released custody to them. Prior to leaving the jail, I informed Mr. Phillips he was being cited for Driving Under the Influence of Alcohol 1st offense, Racing, Laying Drag, Speeding 77/45, and reckless driving. He was given a court date of January 18, 2022.
Mr. Phillips cooperated throughout the entire process. Prior to beginning of shift I searched the rear of my patrol vehicle with no contraband being found Prior to leaving the jail my vehicle was again searched with no contraband being found.
