On 04/26/26 at 0020 hours, I was conducting a foot patrol at 1008 W Oglethorpe Hwy (Latin Nation) when I observed a white Dodge Charger (GA [REDACTED]) with an open container of Hennessey in plain view in the back seat.

At 0031 I observed an individual enter that vehicle and leave the parking lot of Latin Nation without headlights or taillights on. I initiated a traffic stop with that vehicle and made contact with Mr. Devaughn Harper. I advised Mr. Harper on the reason for the traffic stop. The open container of Hennessey was still visible in the back seat. He stated that the bottle did not belong to him.

SPO Parmentier (193) arrived on scene. Mr. Harper stated he was unaware the lights were not turned on because he had the lights set to automatic. He stated he had not consumed any alcohol at the business. SPO Parmentier observed slurred speech, glossy eyes and an odor of an alcoholic substance. SPO Parmentier asked Mr. Harper if he would be willing to conduct Standardized Field Sobriety Tests (SFSTs). Mr. Harper agreed and exited the vehicle.

SPO Parmentier gave Mr. Harper instructions on how to perform the SFSTs. Mr. Harper performed the SFSTs. SPO Parmentier gave Mr. Harper a Preliminary Breath Test (PBT). After the PBT was complete, Mr. Harper was placed in handcuffs and placed under arrest for Driving Under the Influence of Alcohol. The open container of Hennessey was removed from the back seat and the remaining contents of the bottle were emptied onto the ground. Mr. Harper later stated he had consumed alcohol at Latin Nation, but stated he had only taken one shot of liquor before leaving.

The vehicle was released to [REDACTED BY AGENCY] and [REDACTED BY AGENCY].

Mr. Harper was transported to the Hinesville Police Department and an Intoxilyzer Screen was conducted to measure the amount of alcohol in his system. Mr. Harper had a Blood Alcohol Content (BAC) of 0.142.

Mr. Harper was transported and released to Liberty County Jail. The arrest and transport of Mr. Harper followed department protocol consisting of the suspect being searched, handcuffs being applied, checked for proper fit and double locked. Mr. Harper was placed in the backseat of my patrol vehicle and was seat belted in for transport. The vehicle was searched prior to and after transport with no contraband found. I read Mr Harper the Georgia Implied Consent Notice for suspects age 21 or over asking for breath, Mr Harper replied “Yes”.

Upon search of Mr. Harper’s person incident to arrest, no contraband was found.

Mr. Harper was released to the custody of Liberty County detention staff without incident.

Mr. Harper was issued citations for Driving Under the Influence of Alcohol (OCGA 40-6-391), Possession of an Open Container of Alcohol (OCGA 40-6-253), and Headlights Required 1/2 Hour after Sunset (OCGA 40-8-20).
