On 04/25/2026 at approximately 0227 hours, I was patrolling the area of E. Hendry Street, approaching Ga. 38. I observed a Dodge Charger traveling behind me with no headlights on. I observed the Charger to only have it’s daytime running lights on. I pulled to the shoulder of the roadway, to allow the Charger to pass me. Once the red Dodge Charger passed me, I activated my emergency equipment to initiate a traffic stop, as we were turning westbound onto Ga. 38. The Charger turned onto Ryon Avenue and came to a complete stop.
I approached on the driver’s side and made contact with the driver, Emmanuel Green. I introduced myself and explained the reason for the traffic stop. Mr. Green advised that his headlights mess up sometimes, and don’t work properly. I observed the headlight switch to be turned to just the daytime running lights, not to the headlights. While speaking with Mr. Green, I observed the odor commonly associated with that of an alcoholic beverage emitting from within the vehicle. I also observed Mr. Green to have bloodshot and watery eyes.
I asked Mr. Green if he consumed any alcoholic beverages tonight. Mr. Green stated that he went to Frozen and had one drink around 2400 hours. Mr. Green advised that it was a Tequila Sunrise that he had to drink. Mr. Green provided me a Georgia driver’s license and I went back to my patrol vehicle.
I reapproached the vehicle on the driver’s side and requested Mr. Green to exit. Once Mr. Green exited his vehicle, he asked if he could take his shoes off because they were hurting his feet. While Mr. Green was removing his shoes, I observed him to use his vehicle for balance. I told Mr. Green to go to the front of my patrol vehicle, so I could conduct a DUI investigation. Mr. Green advised again that he drank one Tequila Sunrise and that he is a “lightweight”, and that he does not really drink. I asked Mr. Green if he would participate in Standardized Field Sobriety Testing. Mr. Green agreed to participate in testing.
Testing was conducted in a asphalt parking lot. Mr. Green was barefooted during testing. Lighting consisted of street lights, vehicle headlights and my flashlight. All test were properly explained, with Mr. Green verbally acknowledging that he understood each test, before he began a test. All appropriate medical questions were asked.
1st. test conducted, Horizontal Gaze Nystagmus. Equal pupil size and equal tracking were present. 6 out of 6 clues observed.
1.) Lack of smooth pursuit, both eyes.
2.) Distinct and sustained Nystagmus at maximum deviation, both eyes.
3.) Onset of Nystagmus prior to a 45 degree angle, both eyes.
2nd. test conducted, Walk and Turn. 4 out of 8 clues observed.
1.) Stopped walking.
2.) Missed heel to toe.
3.) Improper turn.
4.) Incorrect number of steps. Mr. Green took 10 steps on his first set of 9 steps.
3rd. test conducted, One Leg Stand. 1 out of 4 clues observed.
1.) Swayed while balancing.
After testing was completed, I asked Mr. Green if he would provide a breath sample on my Preliminary Breath Tester. Mr. Green agreed to the sample. The sample showed positive for Ethyl alcohol (0.098). Based off the clues I observed from Mr. Green and the SFST clues, I determined him to be under the influence of alcohol and unsafe to operate a motor vehicle. Mr. Green was placed under arrest in a set of double locked handcuffs, which were checked for proper fitment. I immediately read Mr. Green Georgia Implied Consent Notice for Suspects Aged 21 or Over, from my green card.
I requested Mr. Green to submit to the state administered chemical test of his breath. Mr. Green verbally agreed to the state test. Mr. Green was searched incident to arrest, with no contraband being located. I glanced in the windows and did not observe any open containers in plain view, a search of the vehicle, to check for sources of intoxication was not conducted, due to not having another Deputy on scene with me.
Mr. Green requested [REDACTED BY AGENCY] take possession of his vehicle. Once [REDACTED BY AGENCY] arrived on scene, the vehicle was released to her. I transported Mr. Green to the Liberty County Jail, where I operated the Intoxilyzer 9000 (permit #: 953546). Mr. Green provided the 2 samples. Mr. Green’s BrAC returned at 0.115. Mr. Green was turned over to jail staff on the charges of driving under the influence and headlight requirements.
A search of the rear transport area of my patrol vehicle was conducted prior to and after transport, with no contraband being located.
