Officer’s Narrative:

I was contacted by Sgt Hooker to assist on a traffic stop where he believed the driver to be possibly under the influence. Upon arrival, I asked Sgt Hooker what he observed. Sgt Hooker stated at approximately 2110 hours he was traveling Eastbound on Ga 38 at Brights lake Road in the inside lane of travel. He stated he observed at grey Nissan Pathfinder with Georgia License display of [REDACTED] traveling in the same direction in the outside lane. He stated he observed the vehicle was failing to maintain their lane. He stated the vehicle crossed the center divider line several times and came into his lane of travel.

He conducted a traffic stop on the vehicle using his emergency lights and sirens. The vehicle came to a stop on Ga 38 at Spencer Gaulden Road. Sgt Hooker pulled the driver out of the vehicle and instructed him to the front of his vehicle. The driver identified as Mr. Mazariegos by name and date of birth. His date of birth was [REDACTED]. He had sever language barrier and had to contact a friend to interpret what Sgt Hooker was telling and asking him.

I arrived on the scene to assist Sgt Hooker. I approached Mr. Mazariegos, who was located at the front of Sgt Hooker’s patrol vehicle. As I began talking to Mr. Mazariegos, I could smell a over whelming odor of alcoholic beverage emitting from his breath. Mr. Mazaariegos’s eyes were bloodshot and watery, He was swaying back and forth. I asked Mr. Mazariegos when was the last time he consumed an alcoholic beverage. He stated he consumed three Budlight beer approximately one hour ago.

I asked Mr. Mazariegos friend who was on the phone to interpret if he would participate in a series of Standardized Field Sobriety Test to make sure he was safe to drive and he stated yes

Field Sobriety Tests:

This evaluation was performed on Ga 38 at Spencer Gaulden Rd. The evaluation surface was straight and level on blacktop. Lighting conditions consisted of patrol vehicle headlights, spotlights, takedown lights, and my flashlight. No surface defects were noted or claimed.

Horizontal Gaze Nystagmus: Mr. Mazariegos stated he had a glass left eye. HGN could not be administer properly do to the glass eye.

Walk and Turn (explained and demonstrated):
Instruction Stage: Lost balance.
Walking Stage (1st Nine): Missed heal to toe on step 1,2,3,4,9,11,12,13,14,15 . Took 16 steps instead of 9 like instructed. Due to the sever language barrier I decided to stop the test and not conduct anymore evaluations.

I used my Department issued PRELIMINARY BREATH TEST (Alco-Sensor III) device to see if Mr. Mazariegos had a positive reading for alcohol on his breath. Mr. Mazariegos agreed to give a breath sample using the (PBT). The results indicated a positive result of 0.180.

Based on my observations and the admission of alcohol consumption, I placed Mr. Mazariegos in handcuffs which were checked for fit and double-locked. I escorted Mr. Mazariegos to the rear of my patrol car and searched his person. No contraband was found. I placed Mr. Mazariegos in the rear passenger’s seat of my patrol car. The rear passenger’s seat was searched after the last transport and no contraband was found. I read Mr. Mazariegos the Georgia implied consent notice for suspects age 21 or over from my green implied consent card on scene. Mr. Mazariegos verbally consented to the blood test.

I searched the wingspan of Mr. Mazariegos vehicle (passenger compartment) for open container of alcohol. None were found.

I allowed Mr. Mazariegos the opportunity to have someone retrieve his vehicle. Mr. Mazariegos stated his boss who lived in Savannah Georgia could retrieve the vehicle. His estimated time of arrival was one hour. I asked dispatch to send the next wrecker service on list. They advised CD’S towing service was enroute. I conducted an inventory of the vehicle. Mr. Mazariegos vehicle was turned over the CD’S wrecker service.

I transported Mr. Mazariegos to the Liberty Regional Medical Center to have his blood drawn. Mr. Mazariegos’ blood was drawn by [REDACTED] and it was documented on Evidence/Property Receipt #09225. The blood kit was later placed into Evidence Locker #3 at the Liberty County Detention Center.

I transported Mr. Mazariegos to the Liberty County Detention Center for further processing. Mr. Mazariegos was turned over to jail staff without incident. He was issued four citation 1) Driving under the influence of alcohol. 2) Driving without a license. 3) Failure to maintain lane and 4) No license on person. The rear seat of our patrol vehicle was searched prior to leaving the jail with no contraband being found. My body-worn camera was active during this incident.
