While working at a GOHS (Governors Office of Highway Safety) traffic checkpoin on Saturday March 5, 2022 at approximately 0220hrs, I was requested to evaluate a driver that was possibly impaired.
I approached the driver, later identified as Ms. Jasmine Smith, and explained the reason for the stop. I requested her license and could immediately smell the strong odor of an alcoholic beverage coming from her person. I asked about the odor and she advised me she consumed 2 cups of alcohol while at the club.
I asked Ms. Smith if she would consent to Field Sobriety Evaluations at this time and she stated yes.
Ms. Smith advised she did not wear glasses or contacts. She also advised me that she had no issues with her legs or back that would prevent her from completing evaluations.
The first evaluation I conducted was the Horizontal Gaze Nystagmus. Ms. Smith’s pupils were of equal size and both equal size and both eyes tracked equally on the stimulus (my finger). I observed lack of smooth pursuit and distinct and sustained Nystagmus at maximum deviation. She showed no signs of vertical Nystagmus. (4 out of 6 clues)
The second evaluation was the walk and turn. Ms. Smith was given verbal instructions and also given a demonstration. She gave a verbal “yes” stating she understood the directions. During this evaluation, I observed Ms. Smith miss heel to toe steps on all steps on the first pass and all steps returning. She then conducted an improper turn, and used her arms for balance. (0 instructional clue and 4 walking clues. 3 total clues)
The third evaluation was the one leg stand. Ms. Smith was given verbal instructions and also given a demonstration. She gave a verbal “yes” stating she understood the instructions. During this evaluation, I observed Ms. Smith use her arms for balance, put her foot down, and sway when balancing. (3 clues).
I then asked Ms. Smith if she would provide a breath sample in my PBT. Ms. Smith agreed and showed a positive result (.068).
Ms. Smith was then placed under arrest for suspicion of DUI. She was searched, handcuffed, checked for fit, and double locked. I read Implied Consent for persons over 21 and requested breath. Ms. Smith agreed to provide a breath sample.
I escorted Ms. Smith to the Intox station and completed the Intox with both her first and second breath results being .063.
She was then allowed to contact her boyfriend whom later arrived and picked up her vehicle. I released custody of her to the detention officers that were on scene.
