On Sunday March 20, 2022 around 0152 hrs While traveling westbound on Hwy 196, I observed a Gray Pontiac ( Ga Tag [REDACTED]) G6 in front of me traveling in the same direction. While behind the vehicle I observed the driver fail to maintain his lane of travel. The driver side front and rear tire crossed over the yellow line several times. While still behind the vehicle, using my Mobile Data Terminal (MDT) I conducted a registration check on the vehicle. When the information returned, it show the registered owner of the vehicle John Butler’s drivers license was suspended.
I followed behind the vehicle as it made a left turn onto Airport Rd. I activated my emergency equipment and conducted a traffic stop on the vehicle as it turned into 2570 West Hwy 196 (Handy land). I conducted a driver side approach and made contact with the driver who I recognized as the registered owner of the vehicle Mr. John Butler due to the photo provided on my (MDT). I explained to Mr. Butler who I was and the reason for the traffic stop. Mr. Butler advised me he did not know his drivers license was suspended.
I returned back to my patrol vehicle and confirmed through 911 dispatch Mr. Butlers driver license was suspended for Failure to appear(FTA). I returned back to the driver side of the vehicle and asked Mr. Butler to exit the vehicle. While still at the driver side of the vehicle I asked the female passenger who was later identified as Mr. Kendra Richardson if she had a valid license. Mr. Richardson said she did not have a valid license.
Once back at the front of my patrol vehicle I completed a search of Mr. Butlers person incident to arrest. Mr. Butler was placed into double-lock handcuffs which were check for fit. While searching the inside of Mr. Butlers wallet which was located in his right rear pocket, I located a yellow Spongbob packet with two multi colored pills and several broken pills, which I suspected to be ecstasy. When I asked about the suspected ecstasy, Mr. Butler said he forgot about them and stated they were ecstasy.
I returned to the passenger side of the vehicle and asked Ms. Richardson to exit the vehicle. Once out the vehicle and standing in front of my patrol vehicle I asked Mr. Richardson if there was anything illegal in the vehicle I needed to know about, before I conducted a search of the vehicle. Mr. Butler advised me there was some marijuana in a little compartment near the CD player.
Ofc. Currier (194) with HPD arrived on scene to assist with the search of Ms. Richardson. Deputy Allen arrived on scene to assist. Ofc. Currier advised me she completed a hand search of Ms. Richardson’s person with no findings. Deputy Allen conducted another search of Mr. Butlers person prior to being seat in the rear of his patrol vehicle, with no findings.
While conducting a search on the interior of the vehicle I located a clear bag with green leafy substance(suspected marijuana) in a small compartment near the CD player, where Mr. Butler stated it would be. No further findings. Deputy Allen transported Mr. Butler to the Liberty County Jail and released him to the booking staff. Deputy Allen advised me the rear of his patrol vehicle was searched before and after transport of Mr. Butler with no findings.
The vehicle was released to Ms. [REDACTED](licensed driver) per Mr. Butler. Ms. Richardson was released from the scene.
