On 07/04/2026 at 0136 hours, Ofc Kalista #150 and I assisted Sgt Wong #143 with a traffic stop at Elora G Miles Pkwy and Veterans Pkwy. Sgt Wong stated the male sitting on the curb appeared to be under the influence.
I contacted the male who identified himself as Mamadou Diallo. While he was sitting on the curb, his speech pattern was consistent with being impaired. I had to ask him several times if he consented to participating in the standardized field sobriety tests. He finally understood what I was asking and consented to participate in the field tests.
I asked him to stand up and walk to the sidewalk. He attempted to stand up; however, he fell back down. He managed to stand up and walk to the sidewalk. He was unsteady while walking and swayed while standing still.
I asked if he had any injuries to his eyes or head. He stated no. I asked if he wore glasses or contacts. He stated no. I asked if he had any physical injuries that would impede his ability to stand or walk. He stated his left knee was hurt due to an accident from two weeks ago. He stated he would be fine to take the field tests.
The first test attempted was the Horizontal Gaze Nystagmus test. I instructed Mr Diallo to stand with his together and to keep his hands down by his side. He was instructed to stay in that starting position. I told Mr Diallo to follow the tip of my pen with his eyes only and to keep his head still. I asked if he understood the instructions, he stated yes.
I began the HGN test. I moved the stimuli and he did not follow the tip of my pen. I asked Mr Diallo several times if he understood the instructions. He stated yes. I began the HGN test again. He did not follow the tip of my pen. He began to sway while standing still and lost his balance. I could not continue the field sobriety test.
During the investigation, I observed Mr Diallo hand slurred speech, the odor of alcohol emitting from his breath, and was unsteady while standing or walking. I was able to determine that Mr. Diallo was impaired and was placed under arrest (handcuffs double locked and checked for fit). He was read implied consent for a chemical test of his blood. He did not consent to providing a sample of his blood. He was searched incident to arrest, and no contraband was found. He was secured in the rear seat of Sgt Wong’s patrol vehicle.
