On November 20, 2021 at 0536 hours, I was traveling eastbound on Georgia 38 in the inside lane of travel. I observed at gold, 2003 Cadillac Deville (GA: [REDACTED]) parked on the shoulder of the road. The vehicle was parked in front 4185 E. Oglethorpe Highway (Liberty County Bus Barn). I activated my emergency equipment and stopped behind the vehicle to further investigate.

I made a driver’s side approach to see if someone was inside the vehicle at this time. I observed a black male driver, who was later identified as Mark Anthony Daniel Jackson, sleeping behind the wheel. I used my hand to knock on the window to try and wake the driver up, but he would not wake up. I radioed for Deputy Kilgore and Deputy Lesinski to come to my traffic stop to assist. I continued to knock on the driver’s window and he finally woke up. I asked the driver to open his door and he began to fumble with the door knob. I told the driver to used the latch, which he did and the door opened. I asked the driver for his driver’s license. He began to look for it, but could not find it. I asked the driver to exit the vehicle which he did. At this time Deputy Kilgore and Deputy Lesinski arrived on scene.

I asked the driver about where he was coming from and he said Hinesville. I asked him about where at in Hinesville and he stated a place where they cook. I asked him about where was he coming from in Hinesville prior to him pulling of to the side of the road and he said right there in Hinesville. I asked him about what he was doing in Hinesville and he said partying. I asked the driver about what he had taken (drugs or prescription medicine) and he said the only thing he had taken was alcohol. I asked him about when did he have his last drink and he said when he left Hinesville. I noticed the driver had droopy eyelids, he was drowsy, he had drunk like behavior, slurred speech, incomplete sentences, dry mouth, his eyes were dilated, and he had the odor of an alcoholic beverage emitting from his breath. I asked the driver if would perform standardized field sobriety and he said yes, but he will not do the walk and turn portion.

Lighting conditions consisted of my flashlight, headlights, and street lights. The exercise surface was flat, smooth, and dry. The driver stated he does not wear glasses. The horizontal gaze nystagmus exercise was explained. When asked if he understood all instructions, he said yes.

I asked the driver about how much he had to drink again and he said some beers. I asked him what are some beers and he said beers.

Based on my observations, the driver was placed under arrest for driving under the influence of alcohol. The driver was placed in double-locked handcuffs which were checked for fit. He was searched incident to arrest and no contraband was found. He was placed in the rear seat of my patrol vehicle. My patrol vehicle was searched after my last transport and no contraband was found. I read the Georgia implied consent notice for suspects age 21 or over, from my green implied consent card on scene to Mr. Jackson and he gave a verbal no for breath.

I conducted a status check of his driver’s license via my MDT (Mobile Data Terminal), he was active and valid. He was then transported to the Liberty County Detention Center for further processing. While en route to the jail, the driver stated the only reason he pulled over was because he was “f*cked up”. I searched the rear seat of my patrol vehicle after transport and no contraband was found. Mr. Jackson was cited for driving under the influence of alcohol.

Mr. Jackson’s vehicle was towed away by Clark’s Towing. An inventory sheet was also completed.

My body-worn camera was activated during this incident.
