On Thursday, April 23, 2026, at 2247 hours, I was traveling westbound on GA 38. I observed a black Toyota Camry GA tag [REDACTED] traveling in front of me. The vehicle failed to maintain its lane by having both driver’s side tires cross the center lines. I activated my emergency equipment (blue lights and siren) and conducted a traffic stop on the vehicle on MLK JR Drive at South Main Street. I conducted a GCIC/NCIC status check of the registration using my in-car Mobile Data Terminal. The status came back showing the vehicle registration had expired as of 10-13-2025.
I made a driver’s side approach on the vehicle and made contact with the driver, Mr. Nicks Alcide. I advised him of the reason he was stopped and asked him for his driver’s license, which he stated he did not have. I could smell a strong odor commonly associated with an alcoholic beverage emitting from his breath as he was speaking, and he had bloodshot red eyes. I asked him how much alcohol he had to drink, and he stated none.
I asked him to step out of the vehicle and walk to the front of my patrol car, which he did. He provided me with his name and date of birth. I conducted a status check of his name and date of birth. The status came back showing him having a suspended driver’s license for (DUI, ALS) with a violation date of 9-26-2024 and a suspension date of 11-11-2024.
I asked him if he would do Standardized Field Sobriety Testing to ensure he was ok to drive, and he stated yes. The results from the test are as follows:
Horizontal Gaze Nystagmus (explained)
1) Lack of smooth pursuit in both eyes.
2) Distinct and sustained Nystagmus at maximum deviation in both eyes.
3) Angle of onset Nystagmus was immediate in both eyes.
Walk and Turn (explained and demonstrated)
1) Unable to maintain balance.
2) Steps off line.
3) Improper turn.
One Leg Stand (explained and demonstrated)
1) Sways.
2) Hops.
3 Drops foot twice.
I asked Mr. Alcide if he would provide a breath sample using my department-issued Preliminary Breath Tester, and he stated yes. The results were positive for Ethyl alcohol (.138). At this time, I placed him under arrest and secured him in double-locked handcuffs that were checked for fit. I searched his person incident to arrest for contraband, with none being located.
I read him the Georgia Implied Consent Notice from my green card on scene, and Mr. Alcide agreed to the state-administered breath test. I placed him in the back seat of my patrol car and seat-belted him in. The back seat of my patrol car was searched and cleared of contraband prior to him getting inside.
Mr. Alcide was unable to have someone come get his vehicle, so I requested the next list tow truck for the vehicle. Dispatch advised Clark’s Towing would be en route. I inventoried the vehicle and released it to Clark’s Towing.
I transported Mr. Alcide to the Liberty County Jail to conduct further testing using the Intoxilyzer 9000 S/N (90-000916). The results indicated a BrAC of (.152). Once testing was complete, I transported him to the sally port at the jail. I turned him over to the booking staff at the jail. He was cited for DUI, expired tag, failure to maintain lane and driving while license suspended. The back seat of my patrol car was searched and cleared of contraband prior to leaving the sally port at the jail.
